I'm from the USA and boyfriend lives in the UK. We are looking into what to do next so we can live together, as i know it takes a long time/process.

my question is, if he comes here on a k-1 visa would he need to have all he needs already(moving here wise) since you cant leave and come back without a i-131. And to my understanding the i-131 takes a few months to get approved aswell.

Well you're way jumping the gun on that one. There's a whole process to conquer first. But yes I would imagine he would need to bring all his necessary items to live here, at least whatever he may need for 6 months or so. After that he can go back to retrieve items if needed.

Yes when the K-1 is issued and he moves you guys get married and apply for AOS (Adjustment of status and also work permit and advanced parole)

Work permit and advanced parole (AP) take about 60-90 days from the day you have filed the AOS and he can leave BUT he will not be able to enter again without the AP card.

SO yes he needs to be ready when he make the move :)

It's best to file the AOS asap right? ( sorry to be repetitive) but once we file the AOS we are fine unless it gets rejected. Because if we don't he can only stay the normal time his passport allows? ( im assuming)

Once you go through the K1 process and the fiancé has visa in hand, they have 5 months from the day of their medical in London to enter the US. Once they enter the US, you have 90 days to marry (in that timeline you can also obtain him an SSN). In the best interest of your then husband, it is wise to file for AOS with AP + EAD (these two fees will get waived if you file in conjunction with AOS). This protects his legal status in the US, instead of being in a sort of limbo state, allows him to travel in and out of the country upon approval of AP, and will allow him to work in the US until the AOS/green card process is complete. It is also helpful to file AOS if you wish to obtain health insurance on the federal marketplace (it's one sort of evidence you can provide).

There are some couples that delay filing, perhaps due to financial reasons.... but in the best interests, legality and protection of their status file as soon as you are able.

No he can stay anyway. But of course if you need the AP card and he needs to work then you need to file the AOS.

People collect evidens after then wedding some can be done before to prepare and then they send it off its $1,070 when you send it all together.
