Hi everyone.

I am from Italy and my fiancé is from the USA. I came to visit him a month ago using the ESTA, but we are thinking about the possibility of getting married before the 90 days expire. Considering that at the border the officer was asking me a lot of questions about what my plans were during my stay, do you think that it is a good idea if we get married?!
The officer thought that I was trying to get a job or to go to school, but I explained to her that I was here just to visit and I showed her my ticket to go back home, so she let me cross the border.

Please help us!!!

Yes you can get married just be prepared with many affidavits when you go for the adjustment interview. And before everyone jumps in, I am not advocating fraud because you did not plan on this happening when you entered and you had a return ticket but life just took over. It happens. Just keep in mind you will not be able to go anywhere until you get your Advanced Parole approved (if it is approved), otherwise, you will remain in the US until you get the greencard.

The first step is to get married. Then follow the guide on here for Adjustment of Status.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
