OZ citizen, B1 B2 holder married to US Citizen

Timeline

If she can prove her domicile from Australia then you dont have to be seperated. If she can't she might have to move ahead of you. As long as she has filed her taxes as she should and you guys have a co-sponsor then there shouldnt be a reason for you not to get the visa. And you do not need a lawyer!

Domicile: That's where we are facing problem. She only traveled to the US 4 times since 2005 and lived only for 4 months altogether. As in property she's got her US savings account in California which is only 1 year old and lots of relative including father and elder sister. She doesn't have to fill out tax return in the US and Australia because she is not earning anything.

I have filled out all the forms and also asked my sister in law to get a US money check from bank.

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30

Medical exam in Stockholm April 13th
Interview on May 16th !!!

POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

The only issue might be showing domicile. Have you read through what can be used as evidence?

  • Find employment in the United States Not possible
  • Secure a residence in the United States We can buy a small property
  • Register children in U.S. schools We can do that
  • Relinquish residence abroad Not possible
  • Other evidence of a U.S. residence She has a savings account which have her father's home address.

Do you think those 3 things will do a trick?

Certainly children attending school would be a pretty big plus.

So if I register my elder son into a California school for next year 1st semester do you guys think that should be enough, including the bank account? if yes then I will send my file.

And thanks for helping guys. I was not getting anywhere before.
