I think your husband is not seeing you making progress towards being self sufficient. Two years is a long time for you to still not be working even at a gas station. You should be able to take the driving test again.

The I864 has been used in multiple cases for suing on spousal support. See Stump vs Stump. Also there were california cases where the divorced beneficiary sued the ex husband. You can just google I864 affidavit of support after divorce. NOTE: Divorce does not end I864 obligations of sponsor. There is a line in I864 that states "Beneficiary may sue the petitioner"

I may have misread the "stress and nuisance" and "safe shelter part" mentioned, withdraw comment on VAWA and removal of conditional CR1.

I864 comment stays as that is advised by my attorney and hence we had to prep the prenup even for K-1 in preparation for the CR1, in case I864 ever becomes an issue in years to come.

She can sue but won't win .

They are still married. There cannot be any judgment to make the husband support her financially so long as they are married.

The case you referenced had nothing to do with I-864. it was just a divorce granted on the basis of "incompatibility" and it took place in OH.

And you are talking about CA. You know state laws varies so why even bring two different states in the same argument?

I have a bus come by once a day..

Not a lot of this story makes sense, failing a US Driving Test?, is that possible?, and in the following 2 years what?

Now most of the people I have heard of around here with no DL are banned for DUI etc but they still seem to get around. There are ways, I did not have transport when I got here.

If she lives in a small town then it is not like travelling from one side of LA to another, she will be looking at minimum wage jobs locally.

Oh it is..I saw this lady one time speed through a parking lot with the DPS officer in tow. Needless to say, that was the end of her road test for that day...lol..

But seriously, OP needs to buckle up and find something to do. Divorce is not easy and the spousal support money might not be enough to support her completely.
