I'm an Australian Citizen that has been living in the UK on a working visa the last year. My partner is American and we are applying for the K1 Fiance Visa so we can get married sometime after September. Can I attend the interview at the US embassy in London as I'm not going back to Australia and this is the country I live in at the moment?

Not sure, but you are Australian citizen living in UK on a visa? Although you are a member of the Commonwealth and entitled to certain rights, I don't know if an American vests any of those rights when marrying or applying for visas for Australians.

In other words, doesn't your partner have to go through the U.S. embassy in Australia? Just because you don't want to go home, your citizenship and permanent abode is Australia, not UK.

I'd like to know a detailed answer. I can't find a clear answer anywhere.

If you review the I-129F form, part 2 / question 36a & 36b (page 5) will ask which embassy or consulate the beneficiary will be applying at. You have to specify that you want it in London. http://www.visajourney.com/examples/Form-I-129F.pdf

However, it also says "NOTE: Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate."

It is best do this during the initial petition stage so that NVC can direct it to the right consulate if/when the petition gets approved. Make sure you put your London address so that you will be in their consulate jurisdiction. I believe you also have to list London on your DS-160 come interview time. Be prepared to go back to Australia though if they decide your visa application should be processed there instead.

Most of times you can. But be sure when you filed I-129F and put which embassy you want them scheduled the interview. Sometimes, though, when you write down the embassy they would still forwarded the approved I-129F to the US embassy in your native country.

Bear in mind that if it is happened then you have emailed them and ask scheduled the interview in the country where you have spent most recent your residence at least 6 months. Many VJ users were successfully did it.

If you are residing in England and will continue to do so during the whole process just fill out in the forms that you are requesting the embassy where in England, it does not have to be your country of origin/birth/citizenship.

"NOTE: Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate."

This note that was posted above is referring to a country NOTof their last residence, your last residence is England............no special request needs to made, just fill out all the forms per the instructions. When it asks what embassy the interview will take place, put the one there where you live.
