Green Card holder getting wife after marriage from India

Hi,

I'm currently on a green card for the last 3 years and getting married in June of 2016. I did find out from the USCIS if I could get my spouse on a tourist visa here to live with me and they mentioned that is fine with them until she gets a visa from the US embassy/consulate.

  • I want to know if she should apply for the visa before marriage or after.
  • What all proof do I require to submit or require later on to show
  • Once the I-130 gets approved by the USCIS how long before she will get a visa
  • Does she get a green card immediately or will their be any kind of condition on the green card
  • Can she stay with me on a tourist visa and go back after 5-6 months and come back again
  • If she can stay with me on a tourist visa does she need to carry specific documents every time she travels to the US

Would appreciate if I could get some thoughts on this.

Your wife can apply for a tourist visa at any time; however it is unlikely to be approved unless she has very strong ties to India. A tourist visa is for tourism, not for moving to the US.

You should apply for her visa ASAP after you are married by sending in the I130 and supporting documents. Because you are an LPR the process should take about 2 years. When this visa is approved, she will get a GC upon entry to the US (it will be mailed to you and in the meantime your passport foil will act as a temp GC for 1 year)

Hi,

  • I want to know if she should apply for the visa before marriage or after. Does not matter, either way she would need to show compelling reasons why she would return to India-such as a job, children, houses, ect
  • What all proof do I require to submit or require later on to show I am not sure which proof you mean, if you mean what proof you will need for the I130 peition then you will need your marriage documents, and documents to establish your relationship (shared bank account, credit cards, trips together, or skype screenshots and chat logs)
  • Once the I-130 gets approved by the USCIS how long before she will get a visa You are an LPR and therefore the entire process will take about 2 years (at current processing rates)
  • Does she get a green card immediately or will their be any kind of condition on the green card She will get a GC upon arrival to the US, it will be a 2 year conditional GC if she enters before your 2nd wedding anniversary and a 10 year GC if she enters after your 2nd wedding anniversary
  • Can she stay with me on a tourist visa and go back after 5-6 months and come back again A tourist visa is for tourism, if granted one, she could spend 6 months in the US and then would need to spend 6 months outside of the US before returning, you cannot live in the US on a tourist visa and she would need to spend more time outside of the US than in the US
  • If she can stay with me on a tourist visa does she need to carry specific documents every time she travels to the US She can visit you on a tourist visa, and it would be best if she brought proof of her ties to India every time she comes, also know that in the event she is granted a B2 visa, admission to the US is still not guaranteed

Would appreciate if I could get some thoughts on this.

Thank you for your swift reply.

She is currently working as a professor in India so if she gets a letter showing she will be returning back to work will that help her get a visa if she applies now before the marriage

eh- it's a slow week back at the NIV Unit - so since you two haven't married yet, I say apply this week for the tourist visa and see what happens.

June 2016 is a long way away, in units of time that include tourist visa adjudication units.
