I need help with what so send for the RFE we just received. We filed I-130, I-485, I-765 concurrently. My spouse just had his biometrics last week. We knew the RFE was coming and it just arrived and here's what it says:

"Submit evidence to establish that the petitioner on form I-130 or decedent on form I-130 is a United States Citizen. Such evidence may include: a birth certificate issued by a civil authority showing birth in the United States, a Puerto Rico Birth Certificate (myst gave been issued on or after July 1, 2010), a copy of the biographical page of the petitioner's unexpired United States passport, a copy of the petitioner's Certificate of Naturalization or Certificate of Citizenship, or a copy of the petitioner's Department of State Form FS-240 (Report of Birth Abroad of a United States Citizen)."

So, I have some questions:

1) I already sent them an original birth certificate, why do they want another - did they lose it? Do I have to send them an original birth certificate again or can I send them a color copy?

2) Do they just want one item from above or should I include the passport biographical page color copy as they ask for?

3) I always thought here on Visa Journey people say to NEVER send just the biographical passport page? However, here is the USCIS sending us a letter asking for just that page and no others? I'm very confused!

4) Do I need to send it back to them with tracking? ie FedEx or Overnight? Do I need to include a cover letter as well and a G-1145 for email / text notification or since I already sent them that with the original packet it's tied to that?

11/02/2016 - Interview Scheduled for 12/01/2016 !!!

12/01/2016 - Interview date (Interview cancelled on 11/18/2016)

01/12/2017 - ACTUAL INTERVIEW IN ST. Louis (need to get new medical submitted)

01/19/2017 - New medical dropped off at USCIS & CASE APPROVED ! I-485 & I-130

01/25/2017 - GREEN CARD IN HAND! - DONE!!!!!!!

11/28/2018 - I-751 packet showing as DELIVERED to USCIS in Dallas

12/04/2018 - Check cashed 

12/19/2018 - I797 NOA received in the mail (18 month extension) - Vermont Service Center

12/17/2019 - New Card is Being Produced (approval following day and card mailed on 12/20)

Hi, it's very sad to here that u got an rfe, anyways you'll be fine just as long as u respond and send them the required documents for the rfe you will be fine! It's possible that they lost it or didn't see it at all, what we did to make sure it's not gonna be lost, we had a cover letter containing the list of all the docs we submitted, luckily we never had rfe during our process. Good luck to u guys

1) Send everything they ask for again, even if they already have it. It is best to give them too much, then not enough. For the birth certificate, send them a duplicate original if you can.

2) Send everything you can. Its best to overload them with proof, them leave them guessing based on what they have already.

3)The biographical page includes all of the information that helps the reviewing agent determine that you are a citizen. I sent mine in and there were no issues whatsoever.

4) I would always send it with tracking so you can confirm that it arrived on a certain day. Also, it gets it into the agent faster if sent directly to the front desk, instead of the PO Box. Including a cover letter is always good so the agent will know whats in the packet. You will not need to do the text notification again.

You should have never have sent an original to the USCIS. Get a certified copy (You'll need it anyhow since you won't be getting your original back.) You can then send them a photocopy of that (front and back) and/or the bio data page of your unexpired passport.

You send it back with the RFE as a cover page. If you have to send it to a PO box make sure to use tracking via USPS. If there is a street address you can use UPS or fedex.

What I sent them was an original (certified) copy that I got from my local city hall two months ago when we started this process. I had to pay $10 per copy so I got a couple. I say "original" because it's not a photocopy and from the source (ie the city hall).
