My fiancee was in Greece for a vacation when i met her. After some months of getting to know each other, she came back to spend time with me. We are now engaged and plan to apply for K-1. I am from Nigeria but have been living in Greece for 6 years. I used to have a resident permit which is now expired and have to wait not less than 1 year and 3 or 4 months in order to get a new permit. Meanwhile, i have applied and now given a temporary paper identified as "NOT" a resident permit but states that "I had applied on a dated day with my passport information and its under review". Can we apply for the K-1 and will the visa be denied because of this reason?

She can do theK1 petition for you but you may have to go back to Nigeria for your interview. Check the reviews of the consulate to see how fussy they are about the applicant being a legal resident where they are interviewed.

This will not be over quickly. You will not enjoy this.

I checked the reviews of the consulate but could not find any help. I sent an an email to the US embassy in Greece and their response was, in my case I can apply. i expected such response knowing fully well that a decision must be made when I apply. Its not as if I have not been living legally in Greece. For so many years I have been living legally but right now applied for a new permit and given a temporary paper which under it was written "DOES NOT REPRESENT A PERMIT" and I have to wait for more 1 year from now in order to get my permit. Can I go with a copy of my expired permit and the new application paper made for a new permit? How best can I be sure that this will work out or may not, if I apply? If I am not issued a visa, will I be given some time to get and submit my permit when its out? Or the visa be denied and my file sent back to USCIS?

I guess it's not a resident permit yet because you are waiting to receive it. The important thing here is that you have something to show you're living documented. Your fiancee can apply and when its time, go for interview I am sure you will get the visa with your evidence of ongoing relationship. In your case, you have been in the country and once had a resident permit. The fact you are waiting for it does not mean you are illegal. Make sure you have something to show them on the day of your interview. They will need to confirm your status in Greece, which will prove you are living in the country and at the time of interview, if your permit is not ready, will confirm your status and issue your visa. Make sure at the time of your interview your application for a permit is not denied, its either same way or ready.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
