hello all!

My wife has her AOS interview in Detroit on March 20. I have a new job now, making a very good salary, so I am filling out a new Affidavit of Support I-864 along with my new employment letter. However, I have not filed my 2005 taxes yet, so on the "current tax year" page of the I-864 I am still writing down 2004 and using the gross adjusted income for that year. I'm avoiding to submit my 2005 taxes before the interview because during that year I had a part time job and was unemployed for half that year (I didnt make enough to meet the poverty guideline for that year).

I dont think it should be a problem writing down the 2004 tax year, taxes are not due till mid april anyway. Should this be a problem? Please provide some comments.

CONSULATE PHASE - MONTREAL

11/29/2004 - Sent in the I-129F Application to NSC

12/02/2004 - NOA1 Approval

02/14/2005 - NOA2 Email notification of case approval! 73 DAYS!!

02/22/2005 - NOA2 Approval through snail mail

03/07/2005 - Received an email from NVC and assigned a case number

03/14/2005 - Called NVC and was informed that the petition was mailed to Montreal Consulate on 03/09/2005

03/14/2005 - Received letter from NVC through snail mail stating petition has been forwarded to Montreal

03/16/2005 - Called Consulate in Montreal and have been notified that Packet 3 has been sent on this day

03/22/2005 - Fiance receives Packet 3 from Montreal

03/23/2005 - Checklist and DS-230 Part I mailed to Montreal

03/29/2005 - Montreal receives checklist and DS-230

04/11/2005 - Packet 4 received and interview date is May 17th

04/19/2005 - Received new appointment letter from Montreal. Interview date May 31, 2005

05/31/2005 - Interview, K1 visa issued!!!

AOS PROCESS

07/07/2005- Got Married!!!

07/23/2005- Sent in AOS, EAD, and AP Applications

07/25/2005- NOA1 for AOS, EAD and AP received

09/22/2005- Received email notification of AP approval

09/26/2005- Received AP documents in the mail

10/26/2005- Received biometrics app. letter for AOS: scheduled for 12/08

11/12/2005- Received biometrics app. letter for EAD: scheduled for 12/29

12/08/2005- Biometrics for AOS and EAD completed

That's the way I read it. Since tax return deadlines are not until April 15th, it would only be wise to file early if they serve to help your case.

As I've told others: don't put off what you can easily do. File your tax return for 2005, as you're going to need to anyways, and bring along the return with your W2s, pay stubs from your shiny new job, and a letter saying you work for New Company as a New Job Role for $This Much Money a year/hour. :)

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
19 July 2005 - NOA 1: I-130 received!
24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!
27 April 2006 - AOS Interview, approved after 10 minutes!
19 May 2006 - 2 year conditional green card.
01 May 2008 - 10 year green card arrives.
09 December 2012 - Assembled N-400 package.
15 January 2013 - Sent package off to Phoenix.
28 January 2013 - RFE: signature missing.
06 February 2013 - NOA 1: N-400 received!
27 February 2013 - Biometrics appointment (Detroit, MI).
01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.

Timeline

We have not filed taxes for 2005 by the time we had interview. The officer did ask why, to which we replied "procrastination." If you have enough of other evidence of living together as a married couple, then not having 2005 taxes should not be an issue.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Timeline

I only had print outs of our 2004 tax returns, just the copy we filed. I think it was just a copy of our 1040 and it was acceptable.
