My 4 years old son was born in United Kingdom , he was born while I was Permanent Resident. Now I sponsored his mom k1 who is also my fiancee and K2 and both were granted visa and will come live with me.

Here my confusion:

1. Is my son a US citizen ?. .

2. Should I file N-600 for citizenship or green card for him?

Additional informations

- I put his name during my citizenship process.

-His birth certificate has my name.

please help.

If you are a citizen and your child is under 18 you can file an N-600 for them.

If the child is in your custody, and he is a permanent resident than the moment you became a citizen he did as well. You can apply for a US passport for him or/and N600 .

Your son will automatically become a US citizen when all three of the following are true at the same time:

* He is under 18

* He is a US permanent resident

* He is living in the US in the custody of a US citizen parent

The first and third will be satisfied when he comes, but the second one won't be as he will be in K-2 status. He needs to do Adjustment of Status to become a permanent resident (and simultaneously become a US citizen).

After he becomes a citizen, he can get a US passport at any time (if you guys want). He can also file N-600 for a Certificate of Citizenship, but that is optional.
