Right on. I think your advice is right in line with what I have been reading and hearing from others. By the way, what do you know about a three month waiting period after the PSA does there part and the district court issues the Certificate of Finality? Somebody noted that this is a standard waiting time in case the other party appeals. It seems to me that the time for appeal would come long before the PSA / NSO records the annulment as complete. Am I wrong?

I believe Cristina16 is saying that you should expect to wait three months for the OSG to do their thing and for the RTC to issue the Certificate of Finality. I have no idea if this step can go any faster. Once you get the Certificate of Finality, then you deal with the LCR and the PSA.

I hope others will chime in.

Yes, that is what I meant. You need the Certificate of Finality / Entry of Judgement before you can start anything with LCR, then PSA/ NSO. There is a standard waiting period in case of any appeal before any decision can be final and executory.

Hello,
I apologize for my bad English. I'm from Italy. Unfortunately in Italy I got no answer, and for this reason I apply in a foreign country forum. I'm from Italy, Trieste. My wife is from Davao City.

My simple question: is normal to wait nine months to get a CENOMAR after the annulment?

Below I have summoned our history - thank you in advance for any response.

In January 2014, through an attorney of Davao City, begins the procedure for the annulment of the marriage of the person who later I married in June 2015 (celebrated by a pastor in front of dozens of witnesses) in Davao. The annulment of my wife's [previous] wedding took very long before to be perfected, one year and half, virtually from beginning 2014 until July 2015, one month * after * our wedding. The lawyer promised us that the CENOMAR, issued after the annulment [of my wife's previous marriage], would have arrived by end 2015, but today, nine months after the annulment, the document has not yet arrived.

The lawyer NEVER should have promised the CENOMAR. He is completely out-of-the-loop and off-the-grid when it comes to this part of the process. Your attorney only has moderate control of the situation while the annulment is in the district court. Even then, it is preposterous that he would make any promises.

Once the court issues the decision, the OSG (Office of Solicitor General) must take possession of the case, hold it without motion for at least fifteen days, and then move forward with their own decision. Assuming all is well, the OSG returns the decision back to the district court where the court will then hold the case without motion for up to ninety days. Once complete, the court will surrender their official release of decision with other documents. The released documents must then be taken to the LCR (Local Civil Registrar) in the both the region / district where the court resides and where the marriage was officiated and recorded.

Next, the LCR (via private courier) will send their completed paperwork / annotated MC to the NSO / PSA in Manila. Prepare to wait even longer. The NSO is in no hurry to process and record your annulment. Standard waiting time is two to three months (even when expedited). Only when the NSO releases the nationally recorded annotated MC can you apply for the CENOMAR. Generally, the CENOMAR can be in your possession anywhere from three days to two weeks after the NSO process is complete.

We actually had to follow up personally with the NSO. Dyn visited the office in Manila to follow up on the case. A month later, she did the same thing again (a long trip from Bohol but worth the time). The second visit to the NSO yielded bad news. They had lost all paperwork sent to them by the LCR in Bohol and they never had any intentions of notifying Dyn. We would have waited forever had she not gone their and asked. By the grace of God, Dyn had all original documents in her possession, and she handed them over to the clerk and go a receipt. Where are we now? Annotated MC and NSO paperwork is supposed to be complete on 11 April.

If possible, ask your fiance to personally visit the NSO for a followup. Nine months is much too long to wait. PM me for additional details please.

It took me 10 days to get the NSO copy and get t personally over there at the main office in Quezon City. NO I didn't give 100 bucks . I gave 500 pesos ( under the table ) plus seafoods from my province . That's all. Normally it wil take 1 month to get it . If you know someone inside it's easy .

This is a case to case basis and highly dependent on your location and how fast LCR forwarded your document to PSA main in Quezon City. Yeah definitely, a contact person in PSA Main will help a lot.

The best way really is to do parallel filing LCR / PSA Main. LCR normally would tell that they will send the docs via LBC and you can follow up after a month to check on your annotated MC. LCR and PSA has their own timeline that no one can actually tell how fast they can encode your records in the system.

So what I did was, after filing in the LCR level, I went to PSA Main to request a copy of my annotated MC. As expected it was not in the system even after 2 weeks. LCR told me it will just take 5 working days. I brought a complete set of my papers and submitted it in PSA main, from there I got my annotated MC after 2 weeks.

Do you have the complete docs? Decision, Entry of Judgement, Certificate of Finality? Do you know if it was already filed in LCR where the case was filed and LCR where the marriage took place? If yes to everything, go to PSA main and file your docs there. Request an annotated MC, if they said it was not yet on the system, tell them you already filed locally and submit all docs that you have. Make sure you have certified true copies, submit that.. keep all originals. They will tell you when to check again..

Dyn traveled from Bohol to Manila to visit the NSO and check progress. She paid the guard p500 to get inside to see the director. Once inside, she sat with the director and paid him p5000 to process and expedite the Annotated MC. He promised to have it ready within a week. No joy. A week came and went. Two weeks came and went. Three weeks came and went. The director did all he could to avoid my fiancé, acting as if he he had never met her. Finally, another clerk stepped in and stated that all of the paperwork was missing and we had to start over. Only in the Philippines, right?

Even with evidence of receipt in hand, Dyn was forced to resubmit all necessary documents and start from scratch. By the grace of God, she is a smart girl and had the foresight to travel with extra original documents. As of now, Dyn has a definitive (take that with a grain of salt) date of completion on 11 April 2016 at 3PM. We shall see. I will keep you updated.

We wish to thank again all the ones who helped us: this week the Certificate of Marriage with annotated divorce/annulment was completed. After in front of God, we can marry also in front of the authorities of this world. Surely the struggle is not definitively ended, but now the sensation is that the road starts to go downhill.

Hi,

 

I hope someone here can shed some light on our situation. My fiance received the court decision of his annulment September 2017. It was filed March this year and brought afterwards to the LCR where they got married. We were informed that the documents were forwarded by the LCR to PSA end of June. The anotated MC & cenomar was supposed to be released last week. However, we were advised that it was declined by PSA due to the documents forwarded to them by LCR in Pampanga were not certified. I am not sure if this is a new policy or not. 

 

Question is, what do they mean that the documents were not certified?

 

How do we know that the docs are certified before LCR forwards them again to PSA?

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

The documents need to be signed and stamped by the judge.  It sounds like they sent unsigned copies.  Sounds like someone dropped the ball.  Go back and get certified copies and deliver them to PSA yourself.  That will be the quickest way to resolve this.  I do suggest starting a new thread to get more responses.

Hi, 

Got my MC saying that the marriage has been null and void however after getting my cenomar still say I'm still married to my ex to have this updated PSA customer service suggests for me to go to the PSA main office in Sta.Mesa providing MC and cenomar, for those who have successfully had their cenomar with annotation can you please advise me if I need to submit the original copies of my documents or just a photo copy and also are there any more documents needed to have this process done, please advice. thank you
