Hello guys,

We've been reading about k1 visa for a few months to figure out the right way and documents to attach to USCIS. My fiancee thought it's the right way to be together is to file for k1 visa. Since he lives in Egypt and I'm in the states. We have all documents to support our love story, the problem my fiancee has a B1/B2 Visa for a few years to visit the states, additionally he applied for the diversity lottery visa last October.

I know guys, you will say his intent to immigrate to the usa is OBVIOUS, he's just trying to knock all doors to be together. We've read that if we are going apply for k1 Visa, he'll lose his visitor visa. secondly the chance in case we didn't success in our petition for k1 visa will reduce his opportunity to visit me.

He was here last August to visit me and he went back home for a purpose of work. We are going to meet again earlier of next year in 2016 after that We are planning to apply for k1 Visa.

Our wondering is what do you suggest for us specially for couples have been through such as a case, is it better to file for k1? or he comes to the states with his visitor visa and then apply for (AOS)? last but not least is there any influence of his applying to diversity lottery visa in any process we go through whether k1 or (AOS)

File for a K-1. Marrying on a tourist visa only works if you had met him during his stay in USA, but since you have known each other before, it will look like a fraud.

And that would be very dangerious.

Second this. I won't just look like fraud, it IS fraud given how you talk about it now before he enters on tourist visa.

Yep. Since he will enter the USA with the intention of marriage and NOT tourism.

Thanks guys for your participant, well I decided to go through k1 visa earlier of next year. :)

well I get another wondering now, about the ability of visiting my fiancee meanwhile my k1 visa in process? is it recommend it? in this case what do I have to prove for the officer at the airport?

You shouldn't have problems visiting him in Egypt.

Just don't marry him during the K-1 visa process, haha.

Unfortunately, yes. Since he is engaged to you, and the K1 process is going on, it will be difficult to convince the officers at the airport that he will return to Egypt. I know of one case where the B1 visa holder was returned from the airport in USA because he said he was going there to "visit my girlfriend" even tho they weren't even engaged!

However, I might be wrong and he may be admitted, but I wouldn't take any chances if I were him.

Go to the regional forum and read up on others' experiences with your Embassy. Egypt is not an easy Embassy, especially for K-1s and you being the USC and him the beneficiary makes for a more difficult case. If he is younger than you, that increases the difficulty.
