I have a question wonderful people. I filed IR 2 for my daughter as a US citizen. She was born out of the US while i was still a green card holder. She is here with me now. Does she automatically gain US citizenship or she has to go through the green card and then wait 3 yeasr to gain citizenship. Also is she automatically get citizen based off my citizenship, how do I go about geting her citizenship papers? she is 5 years old. Thanks in advancee for your response

Hi,

Your daughter automatically became a US citizen when she met the 4 requirements of the Child Citizenship Act;

1. Child under age 18; and

2. Child was admitted as an LPR; and

3. Child has a USC parent; and

4. Child lives with USC parent.

For proof of your child's US citizenship, you can get a US passport or an N-600. You can get both or just one or the other - your choice.

According to the info you provided about your daughter, yes she gained US citizenship. You can apply for get passport and N600 if you wish.
