Hello,

We just received an RFE, the letter consists of two stapled pages. Under 'form omissions' it asks us to 'complete the item(s) circled in red on the attached copy of the petition' but there is nothing attached - just the two pages.

Has this ever happened to anyone else? Is it possible they made a mistake, should we call them?

We actually had a look through the photocopy we made of our packet and noticed that under #14 'have you ever filed for this or any other alien fiance(e) ... before?' We forgot to tick either 'yes' or 'no'. Could this be it? Would it be wise to send the petition again with the box ticked?

Clearly that was your missing link and reason for RFE, all questions need to be answered yes, no, none, n/a. Follow the instructions and return the page they sent you with the question answered.

Not sure if you read my question - there is nothing attached and nothing circled in red. We are assuming it is the mistake I mentioned but do you suggest we just send a newly written petition instead as technically we cannot follow their precise instructions if there is no attached petition with red circle? How easy is it to actually speak to someone at USCIS to find out exactly what to do in this scenario?

Anyone who has experienced this same/similar situation able to tell me what they did in this case?

If you have not yet received the letter stating a reason for the RFE then you need to await that letter and follow the attached instructions in order to respond, a new petition would certainly confuse everything.

I know that, that is why I am asking for advice! You haven't answered my actual question(s)

We have received the letter but it seems they have made a mistake. The reason is 'omitted items'. They have given us instructions to 'COMPLETE THE ITEMS CIRCLED IN RED ON THE ATTACHED COPY OF THE PETITION AND RETURN' but they have not attached a copy of the petition, nor circled anything in red. So how do we act on this? Is it possible that they will send the 'copy of petition' separately even though they said it was attached?

Anyone else? I've read that it is quite difficult to speak to someone at USCIS who will give details.

Getting NOA1 means you now have a receipt number. You can either send an email to USCIS with your receipt number in the subject line then pose the questions regarding the letter and request instructions on how to respond to the RFE or try calling the telephone number listed on your notice.

Relax OP. Its an NFL sunday..might not get tons of immediate traction. Heres a 'similar' scenario but that user seemed as if they had much more to go on http://www.visajourney.com/forums/topic/391595-i-129f-rfe-question/

May need to escalate w/ USCIS or perhaps call /visit the local office?

Haha :) yeah, it is just frustrating that we waited to find out what it was and even with the letter we still don't know! If we call USCIS Monday morning and speak to a tier 2 officer, how likely is it do you think that they will actually be able to tell us what it is/send us said copy of petition with red circle? Thanks

Luckily I haven't got into that situation...and agree w/ you it sucks. I'd review several times albeit I'm sure you have re any other omssions. Search the forums, there were other similar threads but I didn't troll them all. It seems like a very odd scenrio yet, I firmly believe no one here is likely the first to encounter anything anymore.

I found one similar thread but there was no answers really and I couldn't find any follow up to see what they did about it. Google hasn't really been much help either!

CHEERS for your input anyway... Will update so that anyone in the future might find it helpful if they come across the same situation

obviously you can not answer the RFE as received/ make a copy of it and send letter to USCIS stating there was no attached page

i say "don't send original in case someone realizes they messed up and sends the attached paper separtely

Also check your email as the complete instructions may be there

Someone has messed up in mailing out the RFE

you need clariificaiton and u need to write immediately as there is a timeline to get info back to them so tell them in your correspondence that you need the time to respond extended to allow you time to answer the RFE
