Can i file for aos after my I-94 expires? Yes Is there a limit time? No specific time, see below.

The general forum recommendation is to start the AOS process as soon as possible after marriage, the sooner you get started the better.

my I-94 expires nov 15 i will marry on nov 7 but we dont have the money to apply for AOS Now. Can we take a couple of months to get the money and then apply for AOS?

Avoid traveling near the southern US border in the southwestern US while you are in your state of limbo. There are known reports of roving CBP inspection stations. If stopped at such a checkpoint, you may be detained.

Just another good reason to start the AOS process ASAP. The longer you delay, the longer it will be before you can work, do international travel, etc.

As others have already commented, but no problem filing as long as you marry before the I-94 expiration date.

This is not pointing a finger at the OP directly, but I'm still puzzled on how often folks run into money issue during the AOS stage. Maybe it just me, but I budget this cost before my spouse arrived. Hopefully folks aren't sacrificing their AOS fees to get a fancy wedding/honeymoon. Oh well, it's just me making a comment since I see this question posted often.

Timeline

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

It is no problem my husband came to US with visa K-1 and his daughter with visa k-2, we send the AOS 5 months after marriage, their 1-94 was expired one month before and today they received their GC, 3 1/2 month after.

We send our AOS after 3 months that his I-94 was expired
