Hello everyone!

I am new to this forum and would like to inquire regarding my Affidavit of Support documentation. I am in the middle of filling out my application but it requires my Federal Income Tax return for the last three (3) years. I only came to the United States to work just September 2014 so I only have one tax return form to submit. To assure them that I am competent about the support, I would like to attach recent earnings statement which is over the poverty guideline of $19,912 (it shows on my paycheck that I already have around $21,000). So would this work? And what should I put on the boxes about my Federal income tax info? Thank you everyone and hoping to get my wife here too.

You would put the income you made on 2014 in the most recent tax year box and leave the other two blanks. You can provide a statement you started working from sep 2014.

You would put the expected annual income for 2015 in the current annual income box. To prove that you are earning more than the poverty guideline in 2015, include a employment letter form your employer mentioning the annual salary for 2015, supported by copies of few recent paystubs. If your employment letter does not specify annual income, you can calculate annual income for 2015 by your hourly rate x 40 x 52 if you work full time.

You would put the income you made on 2014 in the most recent tax year box and leave the other two blanks. You can provide a statement you started working from sep 2014.

Hello thank you so much. Does it affect the chances of getting approved if there is an Immigration Firm preparing this form? There was a firm involved during the Petition, but now I'm asking during the Visa processing if it has higher chances, my only concern is I'm really new in the United States. Hoping for your reply. Having an immigration firm prepare the filing does not increase the chances of visa approval, it will definitely help though in making sure the filing is done with proper documents. Since you are at visa processing which is pretty much straight forward, you can do it yourself by following guides/instructions in this forum and USCIS. If you think paying a firm is not a problem, then you can definitely have them prepare your filing otherwise it can definitely be done without an immigration firm.

Having an immigration firm prepare the filing does not increase the chances of visa approval, it will definitely help though in making sure the filing is done with proper documents. Since you are at visa processing which is pretty much straight forward, you can do it yourself by following guides/instructions in this forum and USCIS. If you think paying a firm is not a problem, then you can definitely have them prepare your filing otherwise it can definitely be done without an immigration firm.

By the way, I'm on the process of filling out DS-260. So here's my initial steps:

1.Fill out DS-260

2. Submit documents to NVC by mail (Which NVC address? The documents I know are our marriage certificate, Affidavit of Support (with my letter of employment, W-2, pay stubs to support financial capability), police clearance, my spouse's passport, her birth certificate)

Please tell me if there is something I should add/omit. Thank you so much!

For the cover letter that I am sending to the NVC for the civil and AOS, it is okay for me to be the one writing/signing and sending the documents right? It's like I'm submitting the documents on my spouse's behalf. Hoping for your swift reply.

The first step is to choose an agent which can be you, your spouse or any other person. If you have designated yourself as the agent in this case, everything will be submitted and communicated from you.

Hello Arken, the NVC replied and it need additional documents. It needs my IRS Transcript file. It is shown by this statement:

You must submit the following supporting financial evidence:

[x] If you were not required to file a federal income tax return under U.S. tax law, attach a written statement

indicating why you did not file federal income tax returns.

[x] Your 2014 IRS transcript from the most recent tax year. You can get a transcript on the IRS' website:

https://www.irs.gov/individuals/get-transcript. If you cannot get an IRS transcript, please send a photocopy

of your federal individual income tax return. If you provide a photocopy, you must include a copy of every

Form W-2 and Form 1099 that relates to your return(s).

I checked the IRS Website and it requires 5-10 days. Every day counts so always act fast, If you check the statement that I have underlined, it says I can submit a federal individual income tax return. Now my question is, is that tax return the Form 1040EZ? The form's title is Income Tax Return for Single and Joint Filers With No Dependents. Will this form work? Thank you so much! Will be hoping for your swift reply.

If you want to send a copy of tax return and not wait for the tax transcript, you should send the copy of whatever you filed to IRS earlier for the tax year 2014. If you've filed 1040EZ then yes, you will send the copy of that. If you are sending the copy of tax return, you should send all the associated schedules and W2 like the instruction says.

Not sure if there are different rules for Philippines, but I highly doubt you must pay the fee again. May be in Philippines you have the option to pay at the embassy if you have not paid to NVC. That is definitely a one time payment, either to NVC or pay in person at the embassy.
