My husband had his interview for the fiance visa December 10, 2014 and was issued a ineligible under 221g but with no explination other than our stuff would be returned to USCIS for further reiview. The embassy finally returned our stuff to USCIS April 30th 2015 and on the DOS website it says we have been in AP this entire time. I returned to Ghana In July and we decided to marry at that time while I was there. Since our case has been at a complete standstill and we are married now we are going to file the I-130 petition. My question is...... Can I just re file the I-130 and will it cancel out the I-129f petition?

I have read online that if you re file the I-130 petition that it will cancel out the I-129f petition. Is that true or do I have to send in a letter to withdraw I-129f before I can file the I-130 petition?

FYI to anyone going through the Ghana embassy that gets KM as a consular be ready to be dissapointed when you leave your interview. This woman is mean and very rude and denies or AP's almost everyone she interviews and for NO reason!

Write a short withdrawal paragraph with receipt number you could have included in the coverletter or make photocopy of NOA2 and attach letter to withdrawal just to end it all.

Your statement of KM is correct, and also her supervisor Alma Gurski coaches her, during my husband interview she keep leaving the window going to chat with Gurski so his next interview, well let's just say I may have scared km a little, so that left us to deal with Gurski, so I have filed a complaint against both of them so hopefully the next time he is there he won't have to deal with either of them,
