Hello,

I've been in USA for 4 months and for some personal reasons I'm leaving the program.

I'm going back to my country very soon and I would like to apply for a K-1 visa. I have been dating for 2 months and even if we know it is a short time we do love each other and want to get married.

I would like some advice about how much time should I wait before I apply or how would be the best way to prove that this is not a fake marriage because we only have pictures and emails/texts.

You should read the K-1 guide thoroughly since it explains the type of relationship evidence you'll need.

Usually J-1 participants are subject to the 2-year home rule, but, since you're leaving the program without completing it, I'm assuming you won't be subject to this. Although, hopefully someone else will be able to confirm.

You are allowed to not like a job and quit, as long as you don;t overstay your current visa, you will be fine applying for a K1 fiance visa right away.

You have 2 months of time spent together, that is more than many have. If he can visit you in Brazil while you wait for the visa, and meet your family, that will help.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just be aware that at the interview they will most likely question you about your J1, why you quit and how soon into the program you met your fiance. I got those questions at my interview and I spend two years as an Au Pair J1 and one year as student on F1. They wanted to know how far into my J1 visa I had met him. Probably because a lot of Au Pairs find Americans and stay.

Then you qualify for the K-1. There is no minimum time limit.

You only need to prove you two met in person for the K-1 petition filing. You prove your relationship at the interview, which is many months away and your relationship and evidences can grow during this period.

Dec. 2014: Biometrics (didn´t go through)
Jan. 2015: Biometrics for the second time (didn´t go through again)
Feb. 2015: Biometric for the third time!!!!! (it went through this time)
03/06/2015: Interview scheduled ----> didn´t happen due to inclement weather
05/13/2015: I returned to Brazil :´(
06/19/2015: Our former AOS + I-130 were denied
08/14/2015: We filed our new I-130 for CR-1 visa
08/18/2015: Received receipt by mail - Routed to CSC
10/07/2015: NOA2
10/28/2015: NVC Received
11/18/2015: Case number + IIN over the phone
11/19/2015: Received AOS Bill
11/19/2015: Submitted DS-261
11/20/2015: Paid AOS Fee
11/24/2015: Reviewed DS-261 over the phone + unlocked IV fee bill
11/25/2015: Paid IV fee bill
11/30/2015: Mailed AOS and IV packages
12/03/2015: IV fee showed paid
12/03/2015: Filled out and submitted DS-260
12/02/2015: Scan date
12/07/2015: Received email about scan date

04/25/2016: Green Card came in the mail...Thank God, we are done for now.
