K-1 interview question

Is it prior to interview they ask you when you want to get married ( a date)? I was never fussed about a date but my SO wants to get married on our 2 year anniversary which is in October, but wants our daughters to start 3rd grade together. Because my daughter ideally would start school in August and from what I have understood, leaving then would be fine. But it would also mean I couldn't work for 6 months rather than 3? We have been talking about the ins and outs bit by bit, I'm just trying to make sure I am fully informed. We have discussed other things together, but because my daughter won't finish school here until July and also I am doing a college course where the last exam is in June. We felt it best I moved end of July/ Beg of August (processing permitting) and that we would get married in October if everything files well. The problem is when they ask a date, I am worried they would push the interview back if they know we don't want to get married until October and that it might cause my daughter not to be able to start school at the beginning of the school year if we don't put something closer to when they start the interview process?

You have 90 days to marry once entering the US. You don't schedule a wedding with USCIS. They don't care what day you marry. It has to be within the 90 days.

I understand it has to be within the 90 days, but everyone I see that is getting near to the interview process that I have read about mentioned something about a date. That they were asked when they plan to marry. I understand the rules of the visa, it's this additional information as from what I have read it could cause delay to my visa being issued with the London embassy and that my interview could be later, I am concerned about. Not the 90 day rule which I fully comprehend.

From what I remember about the guides here, the date you supply for a wedding is on the DS-160 Applicant Readiness Form. I have seen it recommended several times that you put one as early as possible. It may be a little white lie, but if you are more concerned with your child getting into school at the start of the school year I would put a wedding date in August. It has been confirmed that the USCIS doesn't check up on your actual wedding date. They just care that you get married sometime before the 90 days is up.

Once you get the Visa, you can leave when it best suits you (but remember it expires 6 months from your medical) and your 90 day clock starts from POE. Since October is well within that time, entering the US in August should not cause any issues with wanting to get married in October.

I would recommend checking with your Fiance on how much time you might need to give the school advance notice of the new student. I don't have any children myself so I am clueless as to how all that works but I am sure there are certain steps to registration that have to occur in a timely fashion to be in by the start of the school year.

So far I have read on the school website that she has to have additional vaccinations which I am going to sort out next month as I have to pay for some of them. I'll have a look on the website and see what it says about admissions or ask them when I am over in December. When we went to visit the school in August they said that she could be admitted in year or for the start of the year. I assume since she already has a ssn that I won't have many issues enrolling her in school. We can probably start enrolling her before she even leaves school here as long as my visa is in hand and we know she can defiantly start.

I'm pretty sure it was the DS-160 that I was reading about with the intended wedding date, I know I read people saying to set it earlier. I am also pretty sure that if I leave in August and we don't get married and AOS until October that it's an additional 90 days for my EAD so it'd be nearly 6 months before I can work. So I will have to have a chat with him about that.

That is great news about the school! I have heard that school can be quite difficult to get into when a move is involved, but I could also be confusing that with preschools because I have read that getting into preschools here includes waiting lists, which is crazy!

I agree the not working thing is probably the hardest hurdle of the whole process to get through. I make more than enough to support my Fiance when we get the ball rolling but I know we might have to buy him a few things and then food and utility bill costs go up when you have someones else there, and in your situation it sounds like quite a few extra mouths to feed!

My fiance makes more than above the poverty line. But as you say feeding additional mouths is not easy. I've got savings and I'm going to ask my future mother in law to help me learn how to coupon. I'll need new clothes as most of mine will have to be left behind, but otherwise I can make do. I have a laptop and I won't need a new phone as when I brought a new one I got an unlocked one. Everything else I should be fine and we'll make do. Our bills didn't get too high as we were careful with gas and electric when I was visiting for 6 weeks. It's just the dreaded food bill and getting to the counter wondering if it's bellow $150 for the week!

If it's important to work, then forget the sentiment and marry immediately. It's charming to pick a sentimental date, but it's also cool to have food to eat.

Make up a date. It doesn't matter. They can't hold you to it. They ask for scheduling purposes.

If the child is going to public school, they have to educate anybody who shows up. Planning for shots required is a super plan because they can make you get those before going to class. Previous school records or test scores are a bonus to help with placement in the right class. As an elementary school teacher I had surprise new students brought to my classroom mid-day by the principal on many occasions. Anna couldn't walk or stand at all. Martin spoke only German. I had to wing it. All children have the right to be educated in the public school system. With a private school, there may be limits on how many they can take so waiting lists, interviews, etc to get accepted. I highly recommend starting on the first day of class if your visa timeline allows it. It makes for easier adjustment.

If processing times go as they are for many people at the moment I should hope we'd have it a few months before August. But you never know what is going to happen. It could take longer. But if we have it before, then she will start on day one of grade 3. The only shot I know she doesn't have that she needs is Hep B and I have to pay for it, so I'll be getting the first one done next month. I have to wait for my doctor surgury to employ a new immunization nurse before we can get our Hep A and make sure my Dtap (not hers, hers are up to date).

I agree, where it's lovely to have a sentimental date I would be quite happy to have a court house thing and have a proper ceremony later. I don't want to make it difficult for us by not being able to work for a long period of time. Yes I have savings, but I have to pay for the visa, flights, a learners permit (for driving), a college course (which is $700) and various other moving expenses with those savings. It's not a huge amount, but it's enough for what we need and maybe a bit left over to be able to help out with the food bills until I can get a job. But these are things I have discussed with my SO and we'll talk about it in more depth as time allows. We always do. It's just getting a time when we can talk where the kids aren't listening in lol.

I didn't realize that no. Thanks for letting me know. I thought you just needed your SSN to get a permit. I don't have a timeline just yet. It could end up going to TSC and taking longer. I've just noticed a lot of them going to CSC and only taking 5-6 months. Who knows what'll happen it could end up taking the 10 months they state on their website. I'm not going into it with any expectations, just hopes that my daughter can start school at the beginning of the school year as it'll cause the least disruption to her education.

Each state makes up their driving laws, but the federal government has put pressure on them to help combat illegal aliens by requiring documentation of status.

The driving thing that is most common--

You need to prove you have legal status in the U.S. As a K1, all you are given (on paper) is 90 days. Your entry is recorded on an I-94 which you could show to get a license. But the license would expire on day 90 when your 90 day admission expires. Many states won't even bother with such a short term license. So the next document that would show your legal status in the U.S. is your EAD card. It will have a one year validity and should get you a one year license. That's the general concept and you have to check with your state for specifics.

For SO's state it is: Social security number, Proof of residency (he'd need me on a bill), proof of full name and date of birth, pass written and eye tests. That's all it says, so I'm not sure if I'd need my EAD or not.
