No, you must meet in person within the two years prior to your filing date. If you haven't met in person, then you can't file, the petition will be denied.

Certified divorce decrees can be obtained from the county clerk where your divorce was filed. Get their phone number and call. I was able to get mine by paying over the phone.

I have question ,Things may get real slow at my job and I may be laid off soon, I will be on unemployment benefits and will loose all my vacation time so i wont be able to visit my girl . Can I still petition for a visa if im on unemployment benefits ?

You can apply while on unemployment benefits but you cannot apply before meeting in person.

This is a two major stage process (with lots of little steps in each stage)

Stage 1: You ask the Department of Homeland Security to permit her to allow her to apply for a visa. They do basic background research to make sure that you meant the minimum requirements (legally able to marry; have seen each other once in the past two years) and that neither of you have certain criminal/legal problems in your past or present.

When approved, that "unlocks" her ability to apply for the visa itself. Unlike a tourist visa, she can't just apply for a fiance visa without being petitioned for.

Stage 2: She applies to the State Department for the visa itself. This is where you have to prove the validity of your relationship and your financial ability to support your household at 125% of the poverty level. This is where being unemployed could become a problem. If you'd already met, you could apply now and wait until you are employed again (or find a co-sponsor) to have the interview at the embassy. But you absloutely must meet in person first or you won't get through Stage 1 and waste that filing fee.

Hi!! I started out this process with my fiance, and because I had quite a complicated past with US visas (loads and loads of visas issued to me since I was 2 years old because of my parents), I hired an immigration attorney.

After being pretty much done with the first part of the process (filing and receiving visa), I can safely say, anyone who DOESN'T have a complicated history or who doesn't have a criminal back ground...etc., really does not need an attourney.

Firstly, they cost a BUTTLOAD of money.
Secondly, they're really REALLY slow.
Thirdly, they charge you for doing something you could totally do yourself. Ex. Writing a letter of intent to marry. Or printing out all your conversations/pictures.

The most complicated thing about this whole process is possibly filing out the forms, however if you take a couple minutes to read everything over, there should be no problem to understand any of it.

I do have another question, My girl in Manila is a live in maid as many there are , and she has traveled to Hong Kong and USA many times with the family she works for on an employee visa of some kind. Will that in any way effect her chances of getting a k1 visa ?
