Background check after N-400 possible ?

Timeline

Hello everyone

To sum it up

I had my interview back in July based on three year rule

Officer said all good but we need to consolidate all your files

I have an old Green card with a different number that I abandoned when I moved back to my home country

Fast forward to today

I just received a letter from uscis stating that a decision cannot be made until the back ground check is completed

I am puzzled - background check after the N-400 interview

I thought they do the due diligence after the finger print before the interview

Any similar situations - advice please ?

It's within their purview to conduct any and all background checks up to the point of your oath taking.

It's just another process they are required to go through. You don't have anything to worry about unless you're in a hurry to get naturalized due to travel reasons or you have a criminal past.

thank you for your input

no criminal background -

only a DUI from 1997 and it was dismissed

did have some urgent travel coming up but can just use my current home country's passport for that i guess

I would not worrry about it, probably the reason why is because you abandoned your Green Card before, they might do some checks on that, I think you going to be okay. Good luck ya sahbi

ok but when i look at the case processing times for my office

it states

5 months -

how is that possible when i am a 10 months old case that has yet been finalized

We are still waiting. It has been a year since we submitted our application and six months since the interivew which went without problems. Passed. However, the decision can not be made pending background checks. Our attorney is confused. Stated he has never seen anything like it. He said it is illegal since it has been 120 days during which a decision needs to be made.

I should add, there is no criminal background or history. Green cards were delayed as well. But for N400 I thought there was a 120 day rule/law during which a decision needs to be made.

My interview was on Nov 2 and recommended for approval. IO told me that each application has to go through the background check again after the interview and it may delay my oath. My initial background check lasted over 7 months before my interview was scheduled. I am keeping my fingers crossed.

I just got the online notification that case status is in oath ceremony

good luck to all still waiting on that illusive background check whether before or after the interview

its been a long journey for me that dates back to 2004 where i received by first conditional green card

that i later abandoned, left the country and had to start from scratch
