Hello VisaJourney community!

I have been researching on this site for a few weeks, and am in the process of preparing the 129-F packet!

So far I've found answers to most of my questions by searching here and on related sites. However I do have a couple of concerns about my application...

My fiancée is a wonderful woman from India, and we have known each other for over three years -- first as co-workers, then as friends, now as a couple. When we met, she was married to an abusive husband and I was also in an unhappy marriage. I completed my divorce over a year ago, but since she is in India and has a child, her divorce took a very long time. Her divorce came through a month ago, and I proposed to her the next day.

My concern is that our situation may raise some red flags in the K-1 process, since 1) we are both divorced and she is very recently divorced, and 2) there is a 16-year age difference between us.

Can anyone advise me on this? I am worried that if I don't hire an attorney for expert guidance, we may face delays or rejection in the K-1 process, although we are deeply in love and deeply committed to spending the rest of our lives together.

I'm not sure if there is any country specify biases but my fiancée and I are in a very similar situation. She is 20 years younger and recently divorced (less than 6 months). We followed the instructions and advice from VJ and her visa was approved two weeks ago. Good luck!

For what it's worth.. among the VJ community, India is classified as high fraud. Some recent cases of India K-1s here have been mixed results.

Not to discourage, but an alternate option.. consider getting married in India (or a third country) and file a Spouse Petition. Submit evidences of a bonafide relationship to neutralize potential flags.

As long as SHE is not 16 years older than you, I see no real problem. You might want to write and submit an "evolution of relationship" letter with your petition though, primarily because of the circumstances of your relationship's beginnings, combined with the recent divorces. Just the facts, no "excuses". :-)
