Hi Everyone,

I wanted to get some input. So my two years of temporary green card was coming up on March 2015 so I sent all the paperwork te remove the conditions of residence before March. There was a delay and they also transferred the files to a different location so I just heard last month (September 2015) that they had received the documents. At the end of September they mailed out an RFE that makes no sense to me. I thought I sent a lot of documentation but apparently it's not enough to prove shared responsibilities.

I submitted:

-2012 and 2013 taxes because the 2014 taxes hadn't been done yet when we filed the I-751

-Phone bill with both our names

-Health Insurance with both our names

-Bank account (just first page that showed both of our names)

-Personal property bill for car with both of our names

-Car title with both of our names

In the RFE it said that the bank statement showed little or no sufficient transaction to support shared responsibilities. Honestly we use our joint bank account just to pay our taxes and our health insurance and sometimes some other small things but we each have our own bank accounts and my husband pays for some bills and I pay for some bills. I don't think that just because we are married we should have to have all our money in one joint account. So I don't know what else to send.

Also they said that our tax returns, auto title and insurance etc is still insufficient to support shared responsibilities. I don't know what they want to see.

We've been living at my husband's sisters house since we got married because we are trying to save up money to get a house. We don't feel financially stable enough to buy our own place yet. Therefore we don't really have a rental agreement or any gas, electric, water bills. They are all under his sisters name. So in a case like this, what else can I send to prove our marriage was entered into good faith?

This is just very frustrating because I honestly thought I had submitted everything we had and it's still not good enough. I would really appreciate it if someone could give me some input on this. If anyone has experienced some difficulty with the paperwork they've presented.

OP, as for the bank statements - for the one joint account you have, send them complete bank statements (not just the first page), covering the entire period of your marriage. You may only have a few payments on your bank account here and there, but it is what it is - you can only send what you have. You should, however, try to find other substantial proof of financial co-mingling and living together. Here is what we sent - maybe this'll help you with some ideas (we are also living with family and, thus, have no utility bills or lease agreements):

  • two tax returns (2013 and 2014), filed jointly
  • drivers licenses showing joint address
  • proof of joint ownership of a piece of land we bought in Dec 2014 for our future primary residence
  • affidavit from his family certifying that we have been living with them since 01/2013
  • credit card statements for three joint credit cards, covering the whole period of our marriage
  • complete checking and savings account statements with both our names on them, covering the whole period of our marriage
  • proof of joint ownership of two cars and one trailer
  • proof of joint car insurance for the whole period of marriage
  • proof of joint health and dental insurance (including bills with both names on them) for the whole period of marriage
  • husband's retirement account showing me as beneficiary
  • joint health POA's
  • photos from throughout our marriage
  • hotel receipts from trips taken together
  • sworn affidavits from family members
  • letters, cards, and bills from throughout our marriage addressed to both of us at our current address

I just got ROC(I751 removing conditions) approved on 9/14. Here are the evidences I sent:

I thought I would get RFE. My husband owns the house but my name isn't on it so I didn't send proof of joint ownership of the house.

  • Joint Federal Tax Return & W2 (2012,2013 and 2014) We used H&R Block printed out every page
  • Car Titles with both our names
  • Verification of Car Insurance with both our names
  • Vehicle Insurance Policy Card with both our names
  • Life Insurance with my name listed as beneficiary
  • Health and Dental Insurance Cards
  • 401(k) Plan listed me as beneficiary
  • Medical Expense Statement with both our names
  • Power Bills with both our names (every other month print out)
  • Bank Statement with Transactions History with both our names (every other month print out)
  • Flight Itineraries visiting families
  • Pictures of families

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
