Expired NOA2 Date and Possible Denial at POE even with VALID K1

Hi everyone,

I've really spent so much time looking for this answer, and I've written the Montreal consulate. I started looking because I read a thread on VJ where people said they were turned away at the POE because their NOA 2 date was expired. Well, we all know that the K1 Visa date is really the only thing that matters and the NOA 2 date applies to the deadline for the interview, medical, and police records. HOWEVER....because there may be a chance we will get turned away for this, I want to get an extension. We have time since he is not moving here until the second week of December.

I wrote the embassy in Montreal and they replied with a standard 'you should be able to get in since the K1 Visa is what they go by, BUT it is up to the CBP to decide because it is their final decision." That's what I am afraid of. I just want to cover all the bases I have control of.

So the question.... how do I get it extended? Who do I contact and has anyone else done this? Others have said that it is automatically extended but we won't know until tomorrow when he picks up the packet mailed to him with his Visa. I know we leave the main envelope sealed but I've read that some people can verify the extension within a document that was mailed to them.

So with all of that info, can someone help us?

Is it even possible to get the NOA2 extended after the Visa is obtained?

As i understood the Visa is valid 6 months from the day the medical is done. But the CBP has a shot of turning you down if they are having a bad day. Which i am pretty sure almost never happends unless they think you pose a security threat.

The NOA 2 is not used for anything at the border. The NOA 2 is good for four months and the visa six.....what the heck sense would it make to go off of the NOA 2 when the visa is still valid. Even if you wanted to you can't get the noa 2 extended as that's just for your interview.

I saw the thread you are talking about and if you read it all everyone said the cbp was completely wrong and made a mistake.

What they are doing can be wrong, and I could possibly demand to speak to a supervisor and get it worked out...or it could be a huge pain and added costs (not likely but not certain either). I am just trying to avoid it if I can.

The Noa2 can get extended if people want a later interview date for whatever reason. Not for POE.

You are creating more work and stress for yourself :) Relax.

Extended for an interview....some consulates have notoriously long waits for interview dates that's why they automatically extend. Manila will automatically extend for a year. It is not for POE. You are trying to do the impossible. That is the petition expiration date. What do you need the petition for now? He has a visa.

Montreal told you that not because of the noa 2 expiration, but because cbp does have final say.

You are worrying about nothing.....but if that's your biggest worry than life is good for you.

I truly appreciate you taking the time to reply, but you're giving me answers that I know. The embassy even wrote me and said that the valid K1 is all you need BUT the CBP can decide at their own descretion if they have questions about any of it. I'm still hoping someone tells me who to contact for an extension. I'd rather worry about it now and at the very least have something official in writing just in case we get someone that's having a bad day, than not be prepared and get delayed. It wasn't one post I saw...I read several.

What were your experiences like at POE?

Not my biggest worry by far....and not what Montreal meant....at least in the reply I read. Would someone that's been through an extension just tell me who to contact?

People are telling you the answer... the answer is you can't have it extended unless you need the extention because you have an interview date that exceeds the expiry of the NOA2.

Well, I did...I guess I'll try to verify the info through them. But sense I already emailed them (since I thought it was obvious too), and they pretty much said yeah, it's not right but if they say it, you do it....I just thought I'd plan ahead. But thanks for being so empathetic and understanding....we all know this process isn't one bit stressful, and being addressed with condescension will surely help.

well when people tell you multiple times and you keep blowing it off it's frustrating. I am trying to help and you don't want to hear that it's impossible, regardless of who to contact.

The only question I've asked is who extends NOA2s. That's it. I've admitted the information is unreliable and I simply wanted to know who to contact to confirm. So imagine my frustration when I reach out to a forum of 'like' individuals and not only do i get one condescending response about who to contact but multiple replies insinuating I'm just not bright enough to follow simple dialogue to understand that my question was answered multiple times, when in fact, everything but my question was answered (with the exception of 'obviously the embassy...thanks). I've never responded to threads in this way....you just never know what people are dealing with day-to-day. Can't wait to wake up in four hours to read all the other understanding replies.

Nope your first question was how do you get it extended. The answer is you can't. Sorry if you didn't like the tone.
