Whose been waiting for namecheck the longest?

869 days for us. Our AOS NOA was 7-2004, but was sent for Namecheck on 10-12-2004, Been through the interview and been waiting for namecheck ever since.

File went to FBI for Name Check on 10-08-2004

AOS interview 2-16-2006

Told that AOS approved "Pending Name Check"

Refiled for EAD 12-12-2006

EAD approved 3-04-2007

I-131-AP filed 2-18-2007

I have written both Senators of my state with no luck.

I have written my district congressman with no luck.

They all say it is out of their hands.

I even wrote GW Bush a letter asking for help , but got no reply.

Jun 28 - CARD PRODUCTION ORDERED!!!

July 06- Green card arrives.

June 19 - NOA extension letter ( card expires June 26th)

Can a lawyer or anyone like that help it?! thats just wrong to wait that long!

You should do an info pass, that is way too long. I read somewhere that the FBI is supposed to have the name checks done within 120 days. Good luck

My N-400 was filed 11-2004, I was informed that it is the name check that's slowing down the process. I will go for the citizenship interview on Monday (3-05). I am assuming that I got my name check cleared, but who knows... I guess I'll find out Monday :wacko:

Thats a good idea, I would do that and talk to a lawyer also.

It really sticks in my throat how they can have a hold on your life for so long. I assume at this point you have gone through every option available to you....I would consider the media! Good luck though!

06/17/05: Check hit bank account.

06/20/05: All 3 NOA's rec'vd! TG!

08/02/05: Biometrics , New Orleans. Pretty uneventful.

08/09/05: EAD Approved!

07/12/06: ......still.........waiting.........

09/26/06: Case Status says interview has been canceled............What interview????

10/23/06: Interview finally scheduled for 12/14/06.

12/14/06: AOS approval pending renewal of Biometrics....Waiting on appt. for ASC!

Will this ever end????

01/17/07: Biometrics scheduled.

02/03/07: Everything complete at our end! Apparently my case file is under somebodys wobbly table leg.

02/27/07: Approval notice finally received by e-mail.....only 641 days!! 1 yr 9 mths!

No we haven't been waiting the longest.

I posted this yesterday (inadvertantly in Off Topic). Thought it might be of interest to those of you who think Infopass, a congressman, or any of that jazz helps.

This is an exact copy and paste of an email I sent yesterday to our Adjudicating Officer and his response.

.....On March 9, 2007 (about 10 days from now) it will have been ONE YEAR since we had our interview for my husband's Adjustment of Status, and FIFTEEN MONTHS since his namecheck inquiry was begun.

I assume there is still no news on his namecheck. Where is his physical file? Is it still in your office in Pittsburgh or has it been sent back to Missouri? Is the check still with the FBI or the National Security Unit?

You asked us to be patient and I think we have been. A year is a very long time to wait but unfortunately all evidence indicates it is going to be a lot longer. We have no reason to hope that my husband will have his greencard any time soon.

We are aware that 'national security' issues are involved. We are aware these things take time. However, after a reasonable period of time passes, one can only assume that laziness is involved. My husband's file must have so many namehits that nobody wants to be bothered getting to the bottom of the issue. It's easier to shuffle it to the bottom of the stack.

In the meanwhile we are trying to find a lender who will make a mortgage loan to an immigrant with no recognizable legal status. My husband has to explain to potential employers that he is 'work authorized' but not a 'permanent resident'. We have been advised that it is also best if he not travel outside the country, because Advance Parole will change his entry status.

How much longer is the United States of America going to make my husband feel as if he is unwelcome? He has done nothing wrong.

The security check remains pending. Until a response is received we are unable to proceed with processing.

We understand that you are anxious and frustrated, however, the law requires all applicants complete a background check to ensure the safety and security of all Americans. As per the information you were previously provided, we are not able to provide a timeframe regarding the processing of security checks

And here in lies the biggest problem with the namecheck. I swear if Osama Bin Laden applied for a Green Card, he'd spend 5 years in namecheck before they caught him because of him having so many hits! In that time (all spent in the USA) he'd have plenty of time to make sure plenty of Americans were not safe and secure.

Delays through namecheck are not making Americans safer, they're making them less safe.

Sure. It's bogus and complete horse manure. But the American Public thinks they are being 'protected'. And what little they DO see in the media about immigrants going through namecheck is being spun as discrimination against Muslims.

Yes, I have done everything in my power except for the "Writ of Mandamus".

I have 3 letters from my Senator explaining why his hands are tied. I have been to numerous Infopass appt's to see if I can urge them to do an Inquiry with the FBI. They steadfastly refuse stating that 3 years is not unduly long, and give me a runaround. I think probably I will wait another 6 months or so and then file the Mandamus. I have done a little research, It can be done by oneself, but you have to be very diligent to cross your T's and dot your I's. We'll see, Hopefully it wont come to that.

I am now having to file for a AP so my wife can go back to her country for some much needed time with her family there. I had to refile for her EAD, It should be back within a week or so. All of these things costs us money that we dont need to waste.

i feel for your situation, however do you really feel confident going through with WOM alone at this time? Are you aware that the new regs state they will no longer expedite namechecks due to pending lititgation? That means IF your case is accepted, then you will have to *go the distance* all the way through federal court.

Infopass won't do anything. Senator won't help, that's also a known thing. Sue them right now. It's been long enough.

That's interesting, so, WOM doesnt even work anymore? Can you link to more info on that subject?
