Hello! First post here on VisaJourney.

I received notice today that the Consulate in Costa Rica received our I-129F petition and we're very excited! However, I have a question about the income level needed for the Affidavit of Support to prove that I can support my fiancé when he moves here. I understand that my income needs to be at least 125% of the federal poverty level for a household size of two. Last year I did not earn enough to meet this requirement and my tax return reflects that. This year I received a significant raise at work and my income now exceeds the required level. Will a statement from my employer along with recent pay stubs be sufficient for proving that I now make enough, or will my 2014 tax return be the only document considered? I would like to avoid dealing with cosponsorship because my family is unfortunately not supportive of our relationship.

List your current income that meets the requirement on the I-134, and supply the letter from employer and recent pay stubs to prove that amount along with 2014 tax return. It should be accepted.

Provide all your pay stubs for the past year and a letter from your employer supporting your increased pay and proof of employment. I had a lawyer, but still found this website helpful in understanding the process. We were caught in the middle of the recognition of same-sex marriages between my husband arriving on a tourist visa and overstaying his visa in 2006 and then being able to get married and apply for a change of status in 2013, so I thought it was worth the money to hire a lawyer. I was more right than I had any idea. We were the first Costa Rican-American couple same-sex couple to apply for a change of status based on the marriage and the first same-sex couple to go into the local service center office. There were issues that our lawyer had to get involved in at that time. Things are more streamlined now.

Oh gosh, congratulations! It sounds like it was a rough journey. I hope Richie and I don't have too much trouble because a lawyer is definitely not an option for us.
