Hi,

I am currently on a Green Card Status right now. I am filing (IR-1/CR1)for my spouse, she lives in Australia right now. She is currently on Bridging Visa now, but soon(May be in 2-3 months) will be a permanent resident of Australia.

We both were born in Bangladesh, so assuming I-130 get approved, the case will be sent to Bangladesh US Embassy for filing. But since there are a lot of cases of Fraudulent, the processing time(security/background checks) there is too high. To acceleate the process, I want to request USCIS to transfer the processing to Australian US Embassy.

To that extent, I want to write an application along with I-130 to USCIS to transfer the case to Australian US Embassy. Is there any other way to do this? Like any form? Anyone else has done this before?

Any advice or information would be helpful. Thank you.

There's another immigration website with information on how to do so. You'll need to provide evidence that she is a legal resident of Australia and sent the request as a letter. There is no form to do this.

Hi,

Well this is not a USCIS issue. NVC assigns the case# to the embassy. So if you need to amend your I-130 that question where will interview be call USCIS now and see what they say. They may not change and you would than have to wait until your petition is approved and went until it gets to NVC. You still have all that processing to so 2 to 4 months there than waiting for interview.

Just FYI after approval at USCIS you are sent to NVC for further processing than wait for interview. So you still have a wait.

Thanks for your help and the quick reply. Really appreciate it. I have few more questions to ask you if you dont mind. I am going to file for I-130 so i just wanted to make sure if i am sending all the required documents:

1. Filled and signed I-130.

2. I-130 filing fee.

3. Filled and signed G-325A form for myself.

4. Filled and signed G-325A form for my spouse.

5. Passport style photo of myself. (Name and signed at the back)
6. Passport style photo of my spouse. (Name and signed at the back)

7. Civil marriage certificate

8. Marriage photo.

9. My green card Copy.
10. Letter to request to change the Embassy.

11. Proof to the supporting letter.

12. Affidavit for Marriage (Since i do not have Joint finance account with my spouse.)
13. G-1145 for e-notification.

Anything else I need to add? Or am I sending any redundant info?

No problem! But, as dwheels said and I know the website was removed but if you googled it, the letter and proof needs to be sent to NVC once your case is approved and sent to NVC. So instead of sending it now to USCIS, send it to NVC after you receive an approval.

Green card I hope you include a photocopy of front and back.

Marriage certificate, if it's not in English, you'll need a translation

All the documents look good otherwise!

Oh you haven't sent in your form okay. Make sure on question 22 you but Australia. And be sure you list your Australian address(Section C) where you are living or they will put you at Bangladesh.

You don't have to write a letter to USCIS you state where you want your interview on the I-130.

Where's your evidence of bonafide marriage, chats, IM's , Skype, phone logs, gifts, your wedding pictures, vacation pictures. You need more than a marriage certificate. Got to show the marriage is ongoing. Joint things aren't that big an issue they know you live apart. But you need to show you communicate.

Hmm. Interesting, I never noticed you could choose the consulate on the I-130 form. You learn something new everyday :D

I don't know if your marriage was arranged or not, but, I know that for most Bengalis since it is, as proof of their marriage all they provide are marriage certificates and pictures of the wedding. The people I know have never sent in chats, call logs, etc. but, if you have them then it's just more evidence for USCIS and can only strengthen your petition.

Well Section C- Question 22 says:

22. Complete the information below if your relative is in the United States and will apply for adjustment of status

My wife is residing in Australia now, so technically I shouldnt fill this section out. Am i missing something here??

In case of Section C, Question 19 I can put her address abroad as Australia. I hope it takes into account automatically choose the Australian consulate.
If you notice, at the end of Question 22, it says:

"NOTE: Designation of a U.S. embassy or consulate outside the country of your relative's last residence does not guarantee acceptance for processing by that post. Acceptance is at the discretion of the designated embassy or consulate."

What does that mean? Since my wife's last residence is in Australia, will she be allowed to choose australian consulate?

And just to make things clear, my wife is now living in Australia on bridging visa. And soon she will become the Permanent Resident over there.

Does anyone has a sample of a filled I-130?
