hello

i need some help regarding marriage certificate in Canada

me and my fiancee are getting married in Canada later this month

i am a US citizen , she is on a student visa in Canada

we have decided to register our marriage in Canada and get the certificate , then a month later have our wedding party in india

the reason i have decided not to get a marriage certificate in India is because Indian marriage certificates needs to be attested from the state it has been issued and then from external affairs ministery which takes some time and both of us don't have that much time

my question is

if we get a marriage certificate in Canada , does that needs to be attested or verified from somewhere for i130 ?

as per this link all you need is a framed or a certified copy of your marriage certificate

also

we have decided to not have her name change after marriage until she comes here , since name change cannot be done if one is on a student visa in canada

so until she comes to the united states we will not have her name change , maybe at the time of green card we will apply for a name change

all her documents will have her name is it is today

will that create any issues later ?

would really appreciate some help

lately i have been hearing that if the marriage certificate issued by the muncipal office is not attested it takes a lot of time for the i130 process as they would verify it , if its attested then they don't check it

these are the guidelines for attestion in india

also my fiancee would change her name on the passport once she is back in canada

for that also , attestion is required as per BLS canada

kinda confuse :(

i see you recently applied for i130

did you attested the certificate anywhere in india ? or did you submit just the copy of the certificate provided by the municipal office

Marriage Certificates

Available. The Hindu and Muslim communities do not usually register marriages, however, marriages by Hindus, Buddhists, Jains or Sikhs may be voluntarily registered under the Hindu Marriage Act of l955. This Act does not apply to Muslims, Parsis, Jews or Christians, who may register their marriages under the Special Marriage Act of l954, or the Christian Marriage Act. Marriage certificates for marriages registered under these Acts may be obtained from the offices of Government Registrar of Marriages, which are located in the headquarters of each district. The certificate will be issued by the Registrar only if the bride and groom personally appear before the official and pay the required fee.

If the marriage certificate was obtained from the Registrar of Marriage, or the registration took place in the presence of a marriage registrar, it is quite acceptable by the US consulate.

we will be getting married in india by the end of this year at a church and then getting our marriage certificate from the local municipal office the next day

is that certificate sufficient for applying for i130 when i come back to US ?

i am hearing from people who recently got married in india that it needs to be attested from the state where you are married and then from MEA

otherwise i130 is gonna take some time

please advise

i am sorry i am replying to an old thread but i am in a similar situation now

I see contradictory information.

Once married, can't marry again.. in the eyes of the law.

Well, speaking from experience, we just got married and got the marriage certificate at the marriage office. We never got it attested. We had no problems at all. Our case was processed within the normal processing time, and he is now here in the US and has been for a while now.
