Hello everyone,

This website is the best tool that exists to help all of us to go through all the steps... :)

I am grateful to the people who will be able to enlighten me.

So I receive a RFE for my i-864.

I think I totally misunderstood how I was supposed to fill out the form.

Our situation:

I immigrated via a visa K1 and we got married on June 3rd.

My wife does not make the poverty line as she is looking for a job.

Her parents are both my sponsors. We are all living in the same home.

At the time, her Dad filled out the i-864 and her Mom the i-864a. They both largely meet the poverty line.

Neither my wife or I filled out an i-864 or i-864a.

I am very confused by this. Does my wife need to fill out the i-864, my father in law the i-864 and my mother in law the i-864a (of course with supporting documentation) ?

Thank you very much for your help.

hi

yes, the petitioner ALWAYS has to file the i864, even if she makes $0 income and attach a letter explaining why she wasn't required to file taxes

Okay thank you so much for your response !

Does that mean that my parents in law both file a i-864a as joint sponsors, or one of the 2 the i-864 and the other the i-864a ?

Ok.

To make sure:

My wife: i-864

My father in law: i-864 - in this case: Part 1 : should I check 1d or 1e ??

My mother in law: i-864A

Thank you very much,

The joint sponsor father-in-law checks off 1d. He is the only joint sponsor. His wife is filing the I-864A as his qualifying household member.
