Petition to reopen case with NVC

I had filed a petition to reopen my stepson's case (NVC) he lives in south america. We filed the I-130 in 2008 and was approved we were trying to get all the money to pay for fees when in 2011 my husbands ex-girlfriend (stepson's mom) filed for child support and sole custody even thought she knew about us trying to bring him. We decided not to follow the process due to uncertainty of what was going to happen. This year she agreed to let him come leave with us. I have sent a petiton or request explaining what had happened. They email me back saying they will review his case. What are my chances that they will reopen it?

i am new to this site, i greatly appreciate any information or advice!

My guess is that you will need to start again, usually if you keep in touch with the Consulate once a year you can keep the file open. Now whether you can keep the old priority date, that I do not know. When it comes to it that is the crux issue.

i say your chances are about 60 percent, as an approved I-130 never expires.

Thank you for your advice, and sorry it took me so long to give an update. I emailed NVC requesting for the case to be reopen and it was!!!! , we paid all fees and sent all documents, we got the interview notice yeay!!! Interview was schedule for tomorrow Dec.9th, but we had to email the embassy to reschedule due to my son having to go get some xrays before the clinic can provide all the results from the medical exam. we are praying for the interview to be reschedule soon...
