Please can anyone help me as I am very confused as to what to do. My mom can be a sponsor but her taxes shows her claiming my two daughters and I file single. My mom asked to claim them because they stayed a portion of the year with her and I didnt work much because of medical issues. When I filled out the I-134 I put that I am responsible for my two and my mom is on responsible for herself. My question is will they go by the tax number or the form for the number of people. She does not make enough for 4 but makes more than enough for two.

If she claimed them on her most recent tax return then they will be included in her household count.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ
