I-130 timeframe question

I'll make this quick and simple. We filed an I-130 on Feb 20th (accepted) of this year via the Vermont service center. Processing times are running at 5mo from the acceptance date, which makes our timeframe up around the end of July.

So, does this mean we will interview around the end of July? Or does this mean that we will get the notice around the end of July, and interview sometime hopefully in August?

Also how much time to they give between notice of the interview in the mail and actual interview; 2 weeks, 30 days?

I know it seems weird to ask, but we are doing AOS inside the immigration court. We have a court day in early September. Odds are MUCH higher of a judge allowing us to AOS the normal way if we have an approved i-130. I'm trying to really get my mind around if we stand a chance to interview before or not, in which case our lawyer and us have to go ask for another court date.

it is exceptionally rare anyone is interviewed for the approval on an I-130 petition.

when it happens, it's normally uscis wanting to interview the uscitizen, the petitioner, because of something untoward found during the adjudication process.

are you certain of an interview prior to I-130 approval?

Yes. Since my husband is in removal proceedings, we must first interview for the i-130, pass it, bring the approval to the judge or the lawyer will request proceedings be terminated in writing, and THEN file the 485 packet.

AOS when someone is in removal is a whole different shade of complicated. You're required to file the i-130 and pass an interview almost like a pre-qualification. There is a small chance we may not have to interview but highly unlikely.

ok, i read yer prior topic. for your exact thing, i've no clue.

i will mention that the I-130 adjudication queue, with interview scheduling, at yer local office is going to be a long slog, as yer local office is backed up.

the 5-month adjudication queue at the 3 service centers; rather that 5 month window, really doesn't exist at the local offices - they have their own version of their own realities for those internal queue durations.

If yer lawyer has a good handle on that local service center, great. otherwise, i suggest an infopass appointment sometime around 4 months and 2 weeks past the submittal time, combined with a phone call into the national call center right prior, asking an ISO on the NSCS to determine the exact location of the casefile.

Wait, I'm confused. So by local office, you're meaning the Vermont Service Center, right? That is what is listed in the bottom left corner of the receipt notice.

I'm in North Carolina if that helps, so maybe Charlotte. Soooooo, our i-130 is at a local office? I haven't asked the lawyer because it seemed like a 'just wait' thing, she just mentioned it is running about 5-6mo. She seems to be pretty familiar with detention and removal so I'll assume she does. I will make some calls tomorrow....we are 4mo in on waiting.

i read 'I-130 approval' and 'interview' together, thinking that I-130 wasn't to be approved unless and until there was an interview with the USCitizen petitioner at the local USCIS office. That's the way those things work, when the two labels are glommed together.

You think VSC solely is gonna adjudicate the casefile? With no local office interview of the USCitzen Petitioner? If that's the case, then great. That's the 'normal path'.

When you wrote of 'interview', were you speaking of the I-485 interview? I never read it that way.

From what my lawyer tells us, we will both be present at the i-130 interview. I'm not certain if it is geared more towards me, him, or both of us. She said don't let it stress us until the notice to interview comes and she will prep us for any/all questions since it could be a bit of a wait.

Lawyer said it is a small chance it can be approved with no interview the 'normal way'. But don't bank on it.

Any interview I am speaking of now is concerning the i-130. I'm not even thinking of the i-485; one step at a time. We know the i-130 interview will take place in Charlotte, NC. So I supposed a local office transfer does make sense in hindsight. So is there anywhere I can start looking to find the Cahrlotte ofice timeframe for this? USCIS portal only shows n-400, i-485 and n-600 times.

I'll ring the NCSC tomorrow. See if I can locate the casefile. As far as I know, it hasn't been transferred anywhere outside of VSC, haven't gotten any notices in the mail or email/text.

I'll just reply here then. Same thing different day.

ok - i am suggesting, regardless,

that somewhere around 4 months and 2 weeks past the NOA-1 receipt date,

you call into NSCS and determine with an ISO where the casefile is physically located. don't put in any service request about it, co-erce the ISO [instead] to read the notes in the electronic record to determine current physical casefile location.

Set up an infopass appointment for 4 months and 3 weeks past NOA-1 receipt date, and when you talk to an IO inside the building, ask for the floor supervisor.

When you get the floor supervisor, face to face, ask the floor supervisor to check in with the I-130 adjudication supervisor (in another part of the building) and ask of that supervisor:

1. did the casefile arrive inside of your building yet?

2. did the FBI namechecks start yet? finish yet?

3. if it's in the building, give me a forecasted date on when we will have the interview here.

Local interviews force casefile movement, from a national service center into the local office. These things take time, also -

2 weeks at the national service center, then

a week in transit then

2 to 4 weeks at the local office to simply log the file as being in the building,

then insertion to the end of the adjudication queue there with

insertion into the end of the queue for local appointment scheduling.

and then ya wait.

knowing exactly where the casefile is, at the 4 months 2 weeks mark, and 4 months 3 weeks mark, gives you some edge over how you can 'interact' with the local USCIS office (instead of waiting around for an interview letter).

I'll write more later, throughout the week, here in yer topic. If you get on a PC, and study my profile, well, you can glean I have a bit o personal knowledge on this stuff, but mostly I study what I read here at VJ over some 5 year span. The advanced search tool USED to be useful here, but since it's been throttled down on date ranges, it's mostly useless.
