HI, I send my form I-129F on december 8 and check was cash on the 11. My case is a little different because i'm requesting for a waiver of meeting requierement due to a hardship. I'm a wheelchair user due to a car accident that I had when I was 17 years old. I know that some of you may think that im crazy trying to bring some one that I do not know in person to usa. My fiancee is from Indonesia and I had seen her only on webcamera. I want it to go and visit her but I found out that the fly is about 20hours which is too much for me. I have spinalcord injury and some metals where implanted closed to my spinal cord to sopport it so some of you can imagine the pain will couse me when I been seating for long time. Well, I just kind of starting geting worry because I may get the notice weather my application is approve or not next month. I did send some letter from my doctors staying that flyng for a long period of time can get me some pressure sores for being seating too long and also the pain on my back. I got a lawyer but she said hardships are very hard to predit. Well I just want to share my history with you guys and please pray for me that CIS will approve my petition because I'm getting very used to to my fiancee ....Thanks...

Thanks, I will see what can I do if petition is denie. I don't know if I can appeal. I guess I better think possitive. Miralcles happend and God knows how much I need her. I hear that CIS will give me 90 days to show them proof that I had meet her on person...I will see I hope the will not make me go all the way to Indonesia it is just hard for me. I know I can take some pain killer but I'm also thinking that if will be hard for me to used the restroom..Well thank you for your prayer that my petition gets approve. Lets have fait that all we get approve

However, there are other users on this board - and if they're around, I'm sure they'll add their input - who both are confined to wheelchairs for life with a debhilitating muscular disease and who were refused the waiver of meeting requirements.

To be honest, since they were refused, I'm not really sure who *would* be approved! And they are BOTH wheelchair-bound. Can your fiance not come and meet you?

To be honest, since they were refused, I'm not really sure who *would* be approved! And they are BOTH wheelchair-bound. Can your fiance not come and meet you?

Well I had filed the K1 petition already, We think about visitor visa before but since september 11 it seens to be more harder to get one and if visitor visa ws denied then more difficuolt to get the fiancee visa....maybe I was wrong infom.......

Technically, a denial on a visitor visa *should* have no impact on a fiancee visa - however, this depends on WHY one was denied. If the denial was for failure to prove ties to a home country, this is a moot point when applying for a fiance visa as the intent IS to immigrate. If she got denied for, say, criminal activity, that would be different. The visas are different classes and you're asked to prove completely different things when applying - what will get you denied for a tourist visa may not necessarily get you denied for a fiance visa.

Either way, to gauge by this other member's case, I really hope that you get the waiver but I think that it's very unlikely: if two completely wheelchair-bound individuals who can't travel at all on their own can't get it, I honestly don't know who can!

That seems to be the best option, although with a denied K-1 petition it may make it difficult for your fiance to prove ties to her home country...after all, by filing the petition, you've made the intention to bring her over here to live known to USCIS. When processing tourist visas, they will look at it.

Another option would be to meet in a third country, one that she could get a visa for and one that might not be such a long flight for you.

Hi... I sincerely hope that you guys will get an exception from the USCIS..keep on praying!

Just incase tho...how long do you think you could stand sitting down on an airplane? Can you travel up to Hongkong? Still too far? =/ Mmm... I was thinking, cuz Indonesians do not need a visa to go to Hongkong and any other South East Asian countries....

Maybe your fiancee could travel to Canada. I am Indonesian and I got the visa to visit Canada in within a week. It was easy and I was in Japan schooling at that time. I also had an Indonesian friend who got a visa to Canada by telling the the consular that she was denied a US Visa and that's why she wanted to go to Canada so she could meet up with her boyfriend cuz they missed each other so much. I love Canadians, they are so damn sweet hehe.... =) Why don't you talk about this with your love one?

damn, I am really sorry, to hear that!

I hope USCIS will have a heart and approve your hardship.....

BUT I also have to agree to the idea, to meet your fiancee in Canada!!!

That would be a short flight for you and easy for her to get there!

You really should try that option first, before risk a denial!!!

The requirement to meet simply states that the parties " shall establish " that they have met within the two year period. This requirement does not dictate who shall travel, how they shall travel, or where they can travel......"

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

hi! i feel for u I do hope everything goes well.My suggestion is how bout u go to Indonesia but take flights that u can have stop overs like spend a night or two in between cities so u can still rest in between and u dont have to endure the discomfort of the long flight.just a thought. I hope u get approved we all share the same longing for our loved ones. :innocent:

Thansk for your advise! does anyone knowns how many hour to fly from california to hongkong? I guess I need to find out how far is from california to canada. Did your friend told you how far is frm indonesia to canada too? Also the problem is that i'm already filed the petition. I guess the only ofpions I had know is wait and see what happend and if visa is denied find out what can I do for cis to proove it.......thanks for your comments they really help....

It takes 12-14 hours flying from California to HK and around 1 hr and 45 mins from California to Vancouver, Canada.
