Hi guys, need you help here, thank you for any input in advance



My legal status F1 international student OPT will expired Nov.1 2015, and I am beneficiary on Green Card based petition. I just heard today that I cannot have adjust of status in the US because no matter what if I got EAD or not due to the green card interview date is beyond Nov.1 2015 of my legal status. Is that true?



Basically, next VB out will be on my PD, and 60-90 days EAD must issued, and I will have it. It doesn't make sense to me, I got EAD which I can legally work and stay in the US, why I should have maintain legal status like F1 international student till the green card interview?

@ CQer - but the EAD is not a visa - its just a work permit and so doesn't grant you any legal status. You can only adjust if you are in status - so you must retain legal status.

the only thing I can think of is that perhaps your friends were married to US citizens...then they can adjust even if they are out of status (it is forgiven).

Unfortunately, when you are petitioned by a GC holder, you do not get your period of being out of status forgiven. You don't get any of the USC benefits.

maybe some other VJers have some thoughts to add

Nope, they were green card based as well. But I understand what you just said, citizen is all good for all.

@ CQer- im looking at your timeline and your case was approved back in Feb 2014....are you already case complete?

its late over here so I am probably missing something but why would your interview be after Nov 15th? you have a Nov 26, 2013 PD. How far are you in the F2A process?

I'm legally stay in the U.S. Therefore no case complete needed, one of VJers told me and I confirmed with my attorney.

All I needed now is wait till my PD become current and fill I-485 adjust of status and that's it. Will fill EAD and travel documents (sry don't remember the form on top of myhead) at the same time, and wait for bio screening get new EAD then last one is green card interview.

So I don't get it why after I got my new EAD still need to maintain legal status, once they issued me EAD which means I'm legal. Hope I explain it well.

yes you explained it well.....but if you read the EAD it states very clearly that it is not a visa. I don't think the EAD means you are "legal" - it just means you have permission to work. You have to have an underlying visa that makes you "legal"......

yes you are very right about the CC... if you are filing Adjustment of Status its not needed (I told you it was late over here!).

Hi,

I'll do my best to give you my opinion.

If one can apply for the I-485, that means that a visa is available (that means, after your PD). If you file your I-485 before your OPT expires, you will not be out of status while your I-485 is being processed. The typical processing time to adjust status is anywhere between 5 and 7 months but in order to not waste time they issue the EAD so that an individual can work. It's not a symbol of legal status per se, however it still means you can legally stay and work while the petition is being processed. I would strongly recommend you do this through an experienced attorney or at least consult with one. I only speak through my own experiences. Since your PD will be current in the next VB, I highly recommend getting all your paper work ready to send. Good luck!
