Hi there again

I only have here is the W-2 Wage and Tax Statement which my fiance send it to me along with affidavit of support docs. So what I wanna know is that Federal Income Tax Return Form 1040 and W-2 Wage and Tax Statement is the same? Is it W-2 is valid for affidavit of support or not? Just asking... thank you again

The w2and 1040 are not the same. You will need either the complete 1040 to include all the schedules and w2's or the tax transshipment available from the IRS. You need more for the 134,

The embassy instructions letter http://photos.state....ruary2015_.pdf states - most recent tax return and W2. Employment letters, pay stubs and bank statements are secondary and usually not asked for.

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

You can get a transcript online or by mail to view your tax account transactions, line-by-line tax return information or wage and income reported to us for a specific tax year. http://www.irs.gov/Individuals/Get-Transcript

In my fiance's case he work in US Navy for almost 12yrs and he doesn't have U.S. Federal income tax return (Form 1040) so he can provide only W-2 Tax return.. what else can i give as proof of support?

He has a W-2 then he has to file a federal tax return.. or the IRS will want to talk to him ;) If he gets a 1099 and he is retired from the Navy, his income may be exempt - I am not a CPA, nor have I ever played one on TV

If his taxable income is below a certain level then he doesn't have to file his tax return, but if that is the case he doesn't have adequate income to meet support requirements. Tell him to email you a copy of his most recent tax return.
