Evidence of Support, I am on unemployment and have just started my own business

Timeline

I quit my job last Feb and cashed out my pension to live off of for the year so $39,000 was deposited into my account last March and that would show on my bank records.

When I ran out (not able to find work) I applied for unemployment and got it, I am now receiving checks while I get my home business up off the ground.

I do not want to be denied on my EOS application for this, my new business promises big income within the next 2-3 months or so (while my I-129F petition is processing).

I own a house and am also part of my father's Living Trust for his estate, I have excellent credit and my bank shows steady income.

Can anyone give me any input on this?

March 15, 2007 - I-129F Sent

March 20, 2007 - NOA1 Received

March 23, 2007 - Touched, April 4, 2007 - Touched , April 5, 2007 - Touched

April 18, 2007 - RFE Email received (waiting for snailmail to see what it is they need)

April 23, 2007 - Received RFE in the mail, mailed out RFE to USCIS using express mail, will get there tomorrow (come on NOA2!)

April 25, 2007 - USCIS Received my RFE info and case has resumed processing

April 26, 2007 - Touched, April 27, 2007 - Touched, April 28, 2007 - TOUCHED AGAIN!

May 10, 2007 - NOA2 Email notification (It took 56 days)

May 16, 2007 - Received NOA2 Notice in snail mail

May 18, 2007 - Received Letter from NVC that they are sending our packet to Juarez Consulate this week

May 26, 2007 - Received Fiance Packet!!!!!!

June 5, 2007 - Medical

June 6, 2007 - Interview at Juarez - Visa Denied (Fiance admitted to smoking marijuana cigarette 6 months before the interview, labeled a 'DRUG ADDICT")

November 18, 2009: I sent an inquiry thru the Juarez website asking about our upcoming end to our ban, what to do etc.

December 14, 2009 - Received a reply from the consulate saying that they will forward a request to the immigration department to request a new appt

December 16, 2009 - Received an email from the consulate saying they are ready for my fiance to come for an open appt anytime

February 2, 2010 - Medical - Trip back to Psych far away in dirty office

February 3, 2010 - Pick up Medical Results

February 4, 2010 - Interview, given form 221(g) "Admin Review" and to come back in 6 months for another medical examination. #######.

Find a co-sponsor to fill out a form I-134. You'll need to be the primary sponsor, but someone else (family member) can supplement sponsorship with you.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

If the consulate decides that what you have is not enough, you may need someone to co-sponsor. What proof you need depends somewhat on each consulate, I would ask them.

Gosh this really has me worried - this is the only part of the process I am freaked out about because I don't have a co-sponsor.

Anyone else have input on this?

Is any other petitioner here self-employed?

you have to show INCOME

since your biz is just getting off the ground - you dont have that to show just yet.

i quit my job in may of 2006, we filed i130 in nov 2006. however i had contracts and made more than i did at my dayjob. i submitted copies of my contracts for the financial info as well as copies of this past years income (broken down by client and month). this was acceptable - there were no questions about my financials. ( i dont have visa in hand yet - but there has been no question on the financial side of things).

so - i wouldnt be so worried that you quit your job and are on your own. i would focus on how to show INCOME. think of anything you could show to proove you have income to meet the required level.

i think you would be better off (safer) getting a co-sponsor.

if you apply and the embassy says that your income isnt sufficient, then they will give you a 221g and require you to complete more paprework - getting a cosponsor. this will basically add up time onto the process. you dont want to add 3 months onto the process. you really need to get a co-sponsor.

The home equity is an asset (value minus mortgages).

The living trust is a zero.

You have no record of the business' income yet, so no way to claim current income (you can certainly try, and document anything you claim, but no guarantees).

Credit matters not, good or bad.

Future income, nope.

However, I pulled together an I-864 in similar circumstances, so keep reading! I'm sure you can find a solution.

Review the rules of support. You might qualify on your own because of assets. Income from a trust is still income but you need to know whether the assets of the trust are available for your support. If you find you don't have sufficient assets, then you might need a strong friend or family member to assume financial responsibility. This is not something to be taken lightly so consider carefully who you might ask for this support.

Income from a trust is still income but you need to know whether the assets of the trust are available for your support.

thanks for that--I didn't consider that the trust might be producing income. I dont' think that the trust's assets will be any help, however. The rules for what qualities an asset must have are at travel.state.gov
