Well Received Form I-797E today

You have not established that the marriage upon which you were granted conditional status was entered into in good Faith. You provided some evidence of marital bona fides. however, the documentation submitted is insufficient because of the following reasons.

1) All of the evidence submitted was dated recently and does not cover the entire marriage period with exception of tax returns that are incomplete, Statements such as W-2 were not attached.

I submitted transcripts for all years with both our names on them, but the wife has not worked so has not W-2s

do they want my W-2s or what do i send my entire tax returns ????

we plan to fly home in June for a visit Now worried about leaving country

We have been inseparable since meeting but don't have much with both our names tried to get car loan with both name but bank wont put her name on loan.

have thousands of pictures

what do we send Now pictures and affidavits from friends ??

They will want to see your W2s to show that you were filing as married....or the W2 shows a status of married. The W2s also show the address where both of you resided but you are saying your wife does not have them. Get all the documents again beginning the time that you got married. Send the tax returns for all the years you have been married. Send more affidavits, more photos, airline tickets if you have them, invitations with both your names...Just send them a whole bunch of evidence and simply overwhelm them.

Are you sure you sent the IRS transcripts? I ask because you mentioned the RFE says,

It's my understanding that they ask for W2s only when tax returns are sent. But if you send tax transcripts, that's better and there'd be no need for W2s.

Also, the evidence you send has to cover the duration of your marriage not just recent evidence. I'd suggest looking for any mail addressed to both of you.

Life Insurance, Auto insurance

Benefiary on retirement accounts

Cellphone family plans etc.

It's my understanding that they ask for W2s only when tax returns are sent. But if you send tax transcripts, that's better and there'd be no need for W2s.

Also, the evidence you send has to cover the duration of your marriage not just recent evidence. I'd suggest looking for any mail addressed to both of you.

Benefiary on retirement accounts

Cellphone family plans etc.

I diffidently sent transcripts. that's what I don't understand thought I was giving more then they asked. also airline tickets home,

but believe they want the Wife's W-2 and we have none. guess I will need to send affidavits from friends and letter explaining the wife didn't work along with my W-2s Pictures

Send tax transcripts that you get from the IRS (either request them to be mailed or download and print them). You won't need W2's with transcripts. Also, transcripts are from the IRS which PROVES you filed. They want the proof. Anyone can send in a filled out tax form, doesn't mean it was filed.

CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

I sent IRS transcripts direct from IRS did not send any W2s thinking Transcripts would be better, But the Wife has NO W2s to file she has not worked in the USA and we have no plans for her to start.

So not really sure what they want> plan to write them a letter this week include my W2s along with affidavits from several friends saying they know us to be happily married. also itinerary of our up coming trip home. but now the wife is worried about getting back into country. Because 2 year card is expired. but we do have letter when if we file say ok to travel

I sent in tax transcripts wih no W-2s. My wife does not work, has a different last name, was not on the mortgage, but we were approved. We sent in evidence of joint bank accounts from the date she was added to the ROC submission covering each quarter. She was added as a joint user on my credit card, so I sent in statements from when she was added to ROC submission. I showed when I aded her as a beneficiary and emergency contract with my employer. I showed she was added to my life insurance policy as beneficiary. I showed she was added to my inherited IRA as beneficiary. I showed her car title with both are names on it. I submitted another certified copy of our Marriage Certificate. We do not have wills or Health Care Power of Attorney or Power of Attorney, yet. I am the only one on all bills. We also sent in evidence--photos and itineraries--of all trips were took together

I would get another set of tax transcripts mailed from the IRS. I would send in all evidence you have from the date of marriage to present. Include your affidavits and trip information of any trips taken together. Write a letter attesting that you are two people trying to combine your lives and got married to accomplish this and not for the purposes of circumventing immigration law--I wrote such a cover letter and outlined the evidence I was including but I feel this was more for my benefit then the USCIS but who knows.

I would go ahead and travel as you have the extension letter which extends the GC for another year--just make certain the airline you are traveling on recognizes the extension letter as some cheaper ones do not. If they do not like the new evidence, you will be called for an interview. Just make certain your travel plans do not interfere with any possible interview.

P. S. My W-2s showed single claiming 0 deductions until recently due to my tax situation. You do not have to change to married on your W-4. You just have to file your taxes as married. The W-4 dictates how much your employer withholds from you paycheck each payday. I wanted them to withhold the maximum amount so I would not have to pay estimated taxes or not a large amount of estimated taxes.

I would also request and send another copy of the tax transcript. On the off-chance that some duma$$ sent you a request for the wrong information as in the W2s just send them so satisfy them but also send the transcript with a note that says you are submitting the tax transcripts once again for their records. That's what I would do. Don't call them out for not paying attention to what they're doing but just provide what they're asking for and a little more along with it (even though you already sent the tax transcripts). I mean what if it's a newbie and they are looking at a tax transcript you sent and they're so stuck on the fact that there are no W2s they aren't even realizing they don't need them. I had an RFE where they said the two amounts on my AOS and tax return didn't match. They DID match but rather than trying to argue through it I just resubmitted the forms. I know it is a bit different now, two years later, but it may still be easier to just provide what they're asking for.
