what to send to USCIS?? I want to start with the i-130

Hello,

I was wondering if anyone who has recently mailed their I-130(+ supporting docs) to the USCIS CALIFORNIA office can help me?? could help me clear up a few things.Im sure this will be helpful for others as well with the changes due to this adam walsh memo and change!!

I think i understand what to do with apply for visa for my wife(who is chinese but living/working in Japan with me of course.)Since we have just learned that DCF is no longer an option, i assume we have the k3 or ir-1/ce-1 are my only 2 current options.Right??

So...if i am correct...I now have to now file my I-130 to a uscis office in California right??

Can you tell me if i am missing anything from here??I dont want to send my info and have it rejected because i forgot to include something.

I believe i dont have to send the original but only copies right??

1. I-130

2. copy of my birth cert.

3. copy of my marriage cert.japanese version and english translation

4. my g-325 4 pages

5. one (MY)passport photo in a bag

6. spouse g-325 4 pages

7. one (spouse )passport photo in a bag

of course the fee...$190(money order since im in Japan)

Is there anything else???

I want to send this 1-130 packet this week. Can you tell if this was you prepared?? You help would be grateful. I cant get help from my consulate or embassay directly.They wont help.

Hi,

I'm also going the K-3 route and that's pretty much what I sent out to USCIS. I included a cover letter explaining that I was submitting an I-130 which will be followed by an I-129F once I receive the NOA1. Also make sure to make copies of everything you send (including cover letter and money order).

Can you not wait a couple of weeks or so, to see what the State Dept works out about DCF?

Do you think DCF will become an option again soon?? If so, would it hurt by sending my I-130 now?? since they are wanting to be a little more strict in checking the backgrounds of the people involved??

I will am waiting to file my taxes for the last 5 years...i havent done it and i will need to get a tax ITTN for my spouse.I think i have found a Acceptance Agent in Japan that can help me and i might have them file for me too since i am clueless on how to file my taxes.I know i am exempt but i still have to file.I wonder if this Acceptance Agent can get me the tax ITTN faster.?????

I read somewhere where someone file their TAXES as if they were single and then sent the irs and adjustment letter that would include their spouses w2 stuff and status as filing jointly. Does anyone know if this is possible??? or is this a bad idea???

Include copy of entire US passport.

Use a felt tip pen and put the name of each person on the back of each passport photo.

On the application, answer every question and if N/A or none fill in each question with either of these comments.

Check form to make sure you answer each question

I do think some news is coming, and that there will be special accomodation made for USCs who live abroad.

You can complete your tax returns as 'married' for the years in which you were married, and you include the W-7 with the fililng--the number is then assigned and they insert the info into your return--you do not wait to get the ITIN back and then file.. W-7 can ONLY be submitted with a tax return.

Have you looked to see if there is an overseas IRS agent in the US Embassy there? You might want to make a run at your own return?

Your last suggestion doesn't fly as far as I know. If you are married, you must file as married (either joint, separate or HofH). Give it a run--it might be easier than you think.

I personally do not think that a couple of weeks wait is going to delay a case much if it ultimately has to be sent to the US. I do think it would slow it down majorly compared to DCF becoming available to you again in the near future.

are you using the I-130 that expires in 1/31/07, or the one that expires in 11/30/07? The 'new' one has some new rules for #7.. having proof for an ongoing marriage.. (documents from friends or other things you can prove - emails, airline tickets, phone records, these such things...) you may want to take a look at my other recent posts.. :yes:

where do i get this new form?? the one that expires 11-30-07?? I was going to send my stuff this week but i cant find it. Does someone have a link or file they can send me??

or is it ok to use the old i-13o file??

I would like to know the answer to this too.

No one can answer that question. If anyone DID apply after the Jan 31st it would be too soon to recv a RFE or a NOA2. You will have to ask this question later down the road once you are ready to apply or see actions w/anyone who applied recently.
