Greetings.



Apologies, it appears I posted this in the wrong forum, so, re-posting here instead.



I am putting together an I-130 package for my wife (just married last fall) and I am trying to choose between showing (through photos and affidavits) that our relationships lasted for 8 years vs potentially getting into the moral character issue, since our relationship started before termination of our previous marriages. One ended in divorce 5 years ago, another through a protracted terminal illness three years ago.



Does INS, oops USCIS care about infidelity on that level?

To be honest, I'm not sure they even care about what happened before you were married as you're showing evidence of a genuine marital relationship. However, it may be an issue in the future, more likely at interview than anywhere else.

Many people don't get divorced until they go to remarry, simply because of the cost to do so. Were you separated or actually cheating on the other spouse? That may be something you want to talk to your wife about because it may be asked at interview. (I don't personally care. ;) Just suggesting a line a questioning.)

Affidavits are low on the evidence scale. Best is time spent together, and after that financial co-mingling and habitation, if possible.

Thank you. Unfortunately we live across the ocean from each other. All we could do is visit each other for 3-4 weeks at a time and frequently meet half way in Europe. And daily telephone conversations couple of hours each. So no cohabitation unless a month here and there qualifies.

If affidavits are of low value, maybe I should not include them as well as older photos. I was not planning on submitting an outline / timeline of our story, although it goes back to high school.

A month here and there does not qualify as cohabitation but does count for time spent together in-person. To echo what NLR posted, evidence of time spent together in-person, regardless of how long it was for remains your strongest evidence.

While the affidavits are of little value, I think the older photos as well as the timeline of your story is useful. In a nutshell, skip the affidavits but go ahead and go with the story timeline and maybe a few older photos. Just my two cents, take it for whatever it's worth to you.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
