Hello every one... just wanted to let you guys know, that I am back on this journey (AGAIN) Some of you might remember me, some may not either way, I am getting ready to submit the I-130 and I am excited yet anxious b/c I kind of remember this process a little too well.

Quick story...

a few yrs ago I filed a k-1 visa, we went to the interview, was approved BUT placed on AP for quite sometime. During the process, we drifted apart, things happened, so I withdrew the visa. He never came to the states.

I met my (now) husband, and short story, 5 visits and 1 year later we got married. I am getting ready to submit my petition, BUT out of curiosity, I looked up my k1 visa case through the CEAC website and it still showed AP!! I've call DOS and USCIS (since the embassy told me that the case was being sent back) and they keep redirecting me to an auto response email. It's been a LONG time since I sent the withdrawal letter to the embassy. I thought by now it should say case closed or something down those lines. Any who, what should I do? Should i just submit the new petition? I will enclose all the emails that was sent to the embassy when they asked me to send a letter of withdrawal via email.

Any information will be appreciated !! Thank you guys!

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I wish I had some good advice for you. I am in a VERY similar situation myself except when I filed for the K1 the beneficiary did not go to the interview. One thing you can try, although I had to call 3 times in order to accomplish it, is to call USCIS and file a service request to withdraw the petition. I sent letters everywhere! So I completely understand where you are at.

my k1 was denied and its still in ap i called USCIS and they told me just send the paperwork for the I-130 that after that my k1 was inactive im waiting on my NOA 1 now

Oh wow, do you think that it would matter that my petition is for someone else? I mean, I cancelled the K1 visa and it has been a year since then. I know that I am entitled to petition for anyone I want (as long as I meet the requirements of course), I was just curious as to why it still say "AP"?

mine dique is still in review but i just didnt want to wait until they made up there mind i doubted it will matter as long as you have proof for the interview that its a real marriage you should be fine you know how dr is de loco lol good luck on yours too
