No Marriage Certificate (K-1 AOS)?

then i think the explanation only says, that the MCcis not available yet, and that you cant wait for it because your i-90? am i correct is going to be expire and will be willing to send the Mc copy by the time it will be available and if they require you for that.. 😉

We just got married in LA County on Friday and was told the same 2 to 3 months for the certified license. On what you are given after marriage ceremony ends it not only says License but also Certificate.

 

The exact words on the document are "License and Certificate of Marriage".

 

With that in mind and reading how others in LA County have been approved with just this document without getting an RFE. As others have said I'm not going to wait 3 months especially when we need EAD/AP. If we get a RFE then so be it but at least will have AP/EAD in advance. Just wanted to let you know you are not alone.

Thats great news! So that does mean EAD/AP will process regardless of the RFE? Poor hubby being home all day getting so bored and he needs to be updated in the Tech field for future work haha

It can, but it can also reset the clock completely. If the customer copy of the "marriage certificate" isn't valid in the eyes of USCIS (which it shouldn't be since your marriage hasn't even been recorded yet and the customer copy is neither signed by a judge nor stamped) then you will receive an RFIE (request for INITIAL evidence). An RFIE can reset the clock completely meaning that your clock starts over from scratch on both EAD and AP once they receive your response to the RFIE.

 

A regular RFE usually only puts your case "on hold", it doesn't reset the clock like an RFIE can. We have had quite a few people in the December filers thread who waited 5-6 months for their EAD because of their RFIEs, so yeah it happens.

Filing for AOS before your i-94 expires isn't a requirement, so for that reason you have nothing to worry about. Some people wait for months and even years to file for AOS. The sad thing is that your life will be on hold until you file, meaning you can't work, drive (in most cases) or travel.
