My wife's ex-husband has "right to visit their son at any time." Can I still get a Visa for son?

My wife's divorce agreement states "Husband shall have the right to visit their son at any time." The father has never visited their four year old son since the divorce two years ago. Do I need something in writing from the father in order to get a visa for the son? Should I just proceed with the I-130 for the son without any documentation from the natural father or a change in the divorce agreement? The marriage and divorce was in China.

The IV Unit in Guangzhou will want to see a letter of permission signed by the father,

clearly stating that he gives his permission for the son to immigrate into the USA.

Get it done in Chinese language, with an official chop/seal/stamp at the hukuo office,

then have it translated at another official office, creating a 'white book' notarial translation .

Usually, this white book is submitted in at NVC, during doc intake process there, is a civil doc added to the child's DS-260/IV application there.

It rolls on to Guangzhou IV - they see it in the casefile.

If timing is a problem, white book can be shown on interview day as well.

If using Electronic Processing for Guangzhou, during NVC doc intake, can scan it in china, email it to you, you send it on via EP email intake, original doc stays in China with spouse or child, but it is turned over on interview day to GUZ IV, Vice-Consul.

It's my understanding (and someone, please correct me if I'm wrong)

that

this document is NOT needed for I-130 submittal.

It is needed during NVC doc intake, but is not pass/fail on completeness at NVC, as

GUZ IV absolutely needs it by interview day.

Correct, the permission letter is not needed at for the I-130 submittal.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Agree with my knowledgeable China Forum colleagues. :thumbs: :thumbs:

My wife had a "White Book" prepared with just such a letter of immigration permission from her ex-husband for my step-son. My wife presented that document at the visa interview process/phase of our K1/K2 immigration journey. We had no problems with folks at the GUZ IV unit.
