I am not sure if anybody can help. I went through a complicated I-130 application process with 2 RFEs until we finally got approved in October 2014.

Nearly 2 months after it is approved, we got our case number today. When we called and we checked online, the preference says F2A not IR1. My husband is a USC and he filed the petition as a USC.

We checked our NOA2 receipt and it also says approval as LPR??

I have heard about people upgrading their petition at NVC because the petitioner got naturalized. But I guess my case was due to error at USCIS.

What do you think we need to do at this stage? Shall we email NVC with a copy of his passport or contact USCIS again to fix the error?

Email asknvc@state.gov with your case number in the subject line.

List your name, DOB and your husband's name and DOB

Attach a photocopy of the USC's birth certificate or passport and request the visa preference be upgraded from F2A to CR1/IR1. It will take them about 60 days to do that.

Alternatively you could try calling up and speaking to a supervisor, but in my experience they have been quite unhelpful due to the sheer numbers of people asking to speak to them.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Does that mean ds261 form will not be available and we can't pay aos fee until our case is upgraded or this will be available in a week time (our case number was assigned 2 days ago)

Not an expert on F2As but I feel you may be right that they won't begin processing you until your case is corrected to Immediate Relative.

NVCExpedite@state.gov is for people who want to expedite their case to the embassy. You'd need good and documented reasons to do this like medical, humanitarian or financial emergencies. All other inquiries go to asknvc@state.gov and that's where your upgrade request should go.

NVC got my last name wrong, so I had to scan over a copy of my passport for them to correct it. That was back when things only took a couple of weeks to process, and that's about how long it took them to get back to me. I sent it to their regular email address, not expedite.

My case was approved on February 2014 and sent to nvc when i was a LPR . On November 5 2014 i became a USC and send a request to upgrade to ir1 on the same day along with a copy of my naturalization certificate and approved letter.till now no any upgrades heard from nvc i keep calling them every week and got their answer wait till 60 days uuuuff today is my 38 day passed.so frustrating

I have my case number and iin number but still im unable to to further steps like ds261 or other

Oh no :( When you called, Did they acknowledge that they have received your email with the copy of cerificate?

I saw some posts from last year that people who upgraded their petition could even fill out the form and paid for the fee. They just didnt get cc until case was upgraded.

I can feel you. Hang on there. I see for F2A the current PD date is still march 2013. ..

I called last wednesday . My approved case is in nvc for 10 months uuuufffff wat the hell is nvc doing ?

Not to get too far away from the OP, but, while I know the wait is hard, you need to remember NVC could not have done anything on your case earlier, since your priority date was not current -- they can't be faulted for the first 9 months. Hopefully, once the upgrade is complete, your case will move quickky.

I am not sure if this helps. I sent an email roughly 43 days ago asking for a case number. They just replied today. Maybe you will be responded by next week.

On the other side, I tried to click on the link for aos payment and it did work. I haven't proceed with the payment yet as my hubby is going to do this tomorrow.

The link for ds260 / ds261 is still not working even though the email says i should fill out the ds-260 (we did use a lawyer when we filed our petition, but we no longer need them at nvc stage so i guess we need to let nvc know).

I will keep you posted.
