yes, starts with 21 days, then must get your passport stamped usually lasts 2 months each time, if late just pay the fee, and can stay up to 16 months total, then must leave the country even for a day and come back and start over with the 21 days again..

sorry if this is a stupid question, but the people i will be dealing with at the embassy, is this the united states government or philippines government im dealing with for all this? its just a hasle to do it every 2 months so i usually do it every 4 or 5 months and pay the fee.

Now it's a 30 day tourist visa upon arrive, changed last summer I believe, then the 59 day extensions. They made some changes at BI in the last couples months as well.

But as said, U.S. embassy doesn't care about Philippine visas... just their own ;)

Now it's a 30 day tourist visa upon arrive, changed last summer I believe, then the 59 day extensions. They made some changes at BI in the last couples months as well.

But as said, U.S. embassy doesn't care about Philippine visas... just their own ;)

oh ok gotcha :)

and the place that i will be dealing with for the CRBA and the DCF is the U.S. Embassy? (u.s officials)?

ok thank you so much

we decided to get married here and file for the DCF

right now we are getting all documents prepaired for our sons CRBA application and process

then will plan to get married in feb, then apply for the CR1 Visa through DCF. hope all goes well

also, do you know what exactly they check on passports? when applying for CRBA or CR1 Visa? my passport has all stamps here in the philippines for past 3 years, but i have not been to the states in the past 3 years.. would that matter? i just want to make sure everything is ok so that i dont waste time or have to make another appointment or go to america and be there for awhile before i can apply for certain things etc. reason why i have not gone back was i wanted to be here for the pregnancy and birth and be here for my son. and would like all to go back the same time too, i dont want to leave him and miss anything.

What they check on the passport for the USC are the dates of travel (as in were you where you needed to be when your fiancee got pregnant ;) ) and of the BIO page.

You have not been in the USA for three years? Big question that pops to mind is INCOME, they require proof of income (from the USA) to meet the 125% poverty guidelines of the I-864P. Do you have this, or will you need a co-sponsor)

You have not been in the USA for three years? Big question that pops to mind is INCOME, they require proof of income (from the USA) to meet the 125% poverty guidelines of the I-864P. Do you have this, or will you need a co-sponsor)

yeah that wont be a problem , just was not sure if me overstaying or stamps being late wont be a problem

and i have a co sponser, my parents who are way above the poverty standards listed..

i do have income but someone said they wont accept it because it was not taxed, and deposited in my philippines bank the past 3 years. i earn anywhere from $3k to $5k a month but if they dont accept my income because i was working in another country, then yes i do have co sponsors who will help.

As long as you have been in the Philippines the required time to file the DCF I don't see any issue then, you have a co-sponsor.

i was advised from my brothers business attorney 2 years ago that because i was living outside the states for over a year and that im not working for a us company that i would not be required to pay tax.

so they dont really care about the stamps? just as long as it shows me being here in the philippines during the times my fiance got pregnant, upcoming wedding etc?

I am not a tax guy so I don't know the rules. Did you pay income taxes in the Philippines? - common sense tells me "there is no free lunch"

I am not a tax guy so I don't know the rules. Did you pay income taxes in the Philippines? - common sense tells me "there is no free lunch"

i meant im not working in the states. the company is physically there but i do the work here. my brother pays taxes then sends me my % we first set it up so we both pay taxes, but was advised by his attorney that i wont need to. so my brother has been paying, once i get back then ill do pay as well.. thats why i will need a co sponsor. even my bank shows i have enough earnings they wont accept it i believe.

yup my passport shows me being here at all thos important times, just no exit stamp.

hoping we can get all completed and approved by next jun or july so can all go back to the states together.. so excited :)

Don't worry about exit stamps... ;)

One more thought, if you are working in the Philippines don't you have a work visa?
