Correct me if I'm wrong but when you enter the US with your visa with the intent to marry within 90 days... you have to stay in the US for 6 months afterwards, right? I don't have a timeline yet but will quite soon as we'll probably be engaged before the end of the year... and as life would have it I lost my mom suddenly on November 6th and in a completely unrelated event, my father was rushed to emergency for life saving brain surgery not even two weeks later. So all this has me wondering... are there any provisions in place so we can cross because of something like this? My dad will have a long recovery and I can't imagine not being able to see him for 6 whole months. Someone please tell me they allow exceptions for something like this. I realize this is still a ways off but I can't help but worry about it now.

What you're thinking of is when you do your aos and need advanced parole. Definitely do not leave the country without that as you could have a ban imposed or difficulty reentering. It does take a bit of time to get but is Worth it for situations like this. I have a sister with brain cancer in Winnipeg and am scared because I don't have AP yet so I would be screwed if anything happened to her. My parents are here so I'm blessed that way at least.

Most if not all apply for AP. Why wouldn't you.

Believe thats why so many get married ASAP when they enter on a K1 so can get the greencard and start working...and be able to travel without so much worry. Best of luck

Further clarification: after you enter on a K1, you can't leave until you get AP. So it's 60- 90 days after applying for AOS (and AP and EAD) but you also have to add the time from when you enter until you get married (and receive the marriage certificate, which you need in order to apply for AOS).

Is it like you can't go back in the U.S.forever? I was talking to my brother and he was playing devil's advocate and asked if I get there on k-1 and things don't work out, and I come back without getting married and AOS, what then?

You can get back in but not with intent to immigrate. So if it doesn't work out, for whatever reason, you can still visit the USA.

The issue is if you get married, leave without AP and try to get back in intending to live there or lie about why you're trying to enter the USA.
