AOS Confusion

Hello all,

I am so lost! We have filed the papers for the CR-1 spouse visa and are now at the phase where it has been sent to the NVC and they have emailed saying that I need to turn in the AOS. The problem is that we are both living overseas on my husband's salary. I don't currently work. I still have residence in the US (my parent's house) but haven't worked there in years.

What on earth form should I fill out? Do I need to get my parents as co-sponsors (which feels ridiculous because we are adults)? My husband and I have no intention of moving to the United States until he secures a job...for which he needs to have a greencard.

Help! I've emailed NVC but haven't heard back and am keen to keep this process moving, I would so appreciate any advice. Thanks!!!

you need a co-sponsor whether its your parents, friends or others, and your co-sponsor have to meet the poverty guidelines

You need to fill out an I-864 Affidavit of Support and since you do not meet the financial requirements to sponsor your husband on your own, yes you will need a joint sponsor and you can use your mom or your dad (whoever makes enough income to satisfy the poverty level requirements for their household number.) That joint sponsor also needs to fill out an I-864. There is nothing ridiculous about using your parents as joint sponsors, many many people do it, especially those living overseas as a U.S. income is required for sponsorship. You will also need to prove your intent to re-establish domicile.

Out of curiosity, did you receive an e-mail notification from NVC regarding the next steps or standard mail.

What are you confused about? You fill out the AOS (I-864) and whoever you choose as a joint sponsor fills out their own I-864. The most recent tax returns need to accompany each filed form.

There's no shame at all in having your parents as joint sponsors. Adults or not, there's no way around the requirements for sponsorship.

if your father filing taxes jointly with your mother you should also submit I864A for your mom.

Thank you everyone for such quick replies! I think I was just making it more complicated than it needed to be. I find that I think I know what I need to and then I look at their websites and feel super confused and unsure. Looks like I'll be asking the parents to sponsor.

AmandaLane - they sent me an email saying what the next step was but then when I followed the link to the instructions I drowned in the list of exceptions and couldn't figure out exactly what I needed to do. The NVC site didn't explain about joint sponsors and I had to do go to a different government website altogether to get that info.

Under Part 6 - do I just leave the federal tax returns blank? I haven't had taxes in the last couple of years because I have had no income.

Nonono, never leave stuff blank unless you enjoy getting RFE's. enter $0 if you received no income.

Yep - I put in 0$ for income but for the tax returns, I haven't had a tax return in two years and they want the last three years, does it mean with zero income that I am void for that?

You leave the first question on that part unchecked and attach a letter to the I-864 stating why you weren't required to file tax returns.
