Hi,

I received a notice that the NVC has forwarded my petition to the Embassy today, and I have some questions, but first some background:

I was relying a little bit on a slower/longer process for NOA2, but since the wave of transfers happened it has sped up considerably. This is great news but causes some issues with timing.

We are set for a wedding in September 2015. If K1 visa expiration is 6 months + 3 months to get married, that gives max of 9 months once we receive the K1 visa. So the earliest possible time to get the visa in hand would be sometime early January 2015.

The petition has expiration of 12/20/2014. So my questions are:

1. What exactly needs to happen before the 12/20/2014 petition expiration date? Do we need to have all packets sent/completed by 12/20/2014? Do we need to at least have an interview date set up by then, even if it the actual interview is past that date? (I know Embassy's can extend the petition date if interview is after, this is Madrid by the way)

2. Has anyone ever requested that the interview date be pushed out? Or even pushed out past the petition expiration date? Is this a fair question to ask the Embassy?

3. Let's say the Embassy receives our petition by 10/1/2014 and my fiancee receives the first packet by 10/14/2014. Can we delay here a bit and as long as we send it all by 12/20/2014 are we still ok?

Ideally we want to have the interview sometime late January 2015 so we have enough time to use it and get married by September 2015. I listed out some questions/scenarios above, but if anyone has any experience or advice on how we can achieve this, please comment. I'm only nervous because I don't want to play with fire and intentionally delay or cause issues, but if it's normal enough then that's ok.

We've also considered having a small legal marriage and then the big one in September 2015, but would like to avoid if possible.

I'm also planning on speaking with the Embassy since I'm sure that they would be able to answer a lot of these questions, but just wanted to reach out to VJ community for any advice! Thanks!!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I read your msg I have some question I check my status on USCIS site and we were approved on 15 Sept Also we were transferred from TSC to CSC

But the fact is we didn`t any notification or email or mail about it I knew about that we were transferred on check my status on USCIS site

My question is how you guys get notifications about changings, that you case has forwarded the petition to the Embassy? Do you receive e-mail or sms to your phone?

Have you considered marrying in a courthouse and then having a ceremony at a later date? This would solve a lot of your problems.

Hi, yes I mentioned that in the green text at the end of the post :) but we would like to avoid if it's possible.

I got emails and letters in mail from USCIS, but only letters from NVC, so far no email.

Contact your consulate about extending the expiration of the approved I-129F petition. Some will automatically extend it, but it is best to contact them about doing so.

Contact your consulate about extending the expiration of the approved I-129F petition. Some will automatically extend it, but it is best to contact them about doing so.

Yes, I will definitely do that once it is received by them. Will keep this post alive in the meantime in case anyone has any advice/experience on the matter. Thanks!
