I am just like axs stuck at USCIS PD Dec 2 2013 on security check. We had a prior K1 petition filed in 2012 when my husband and I was engaged; our K1 only took about 4 months with no issues with security check. At the interview the CO did indeed believed we had a bonifide relationship; however my husband did not get the visa because he needed a waiver which he did not qualify for because we were not married, and they stated I was not a qualifying relative because I was the fiance and not a wife. Long story short was advise to get married in order for him to qualify for the waiver, and told once married the K1 is automatically cancel. I also wrote USCIS just to make certain before marrying and filing the I-130 to cancel my K1 petition; in which, I even got a response back from them. The strange thing is when speaking to a tier 2 office we found out that after 2 years our K1 petition is still open in there computer; therefore now it looks as though I have two petitions: one for a fiance visa and one for a spousal visa. SO FUNNY!!!!! now I can see why we are stuck in security check. Per tier 2 officer he couldn't make sense of it as well. He put me on hold and came back to the phone and said this was the first time he has witness this, advise for me to do a infopass to get this situation taking care of. Try infopass and no dates are available in my area for this month. Wow incredible, so i recently emailed congress, senator, and Rendell Jones who is the deputy director of USCIS. As soon as I emailed Mr. Jones he responded a day later stating he will have his team to look into to this, and that I will be hearing from them soon. meanwhile we are just waiting. Can anyone make sense of why our K1 petition remains open, or have anyone ever heard of this before.

Because you did not withdraw your petition. When you filed the I-130 you needed to write a short letter stating you want to withdraw your K1 petition receipt# XXX.

Hi dwheels76 I did exactly that. I sent them a letter to withdraw the K1 Petition and even received a response back from them stating that they forwarded the request to NVC because the petition was already forwarded, then I received another letter this time from NVC stating they received my request and they were also forwarding to the embassy where the petition was.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
