So, to those who have already received your 10-years Permanent resident card, when you guys got your 2-year conditional one, you had to have an affidavit for financial support and if your spouse did not meet the criteria, some relative/friend/employee could sign the affidavit for you and therefore was responsible financially for you. When you become a 10-year resident and have an income of let's say. 21K a year, are those persons who sign to be your affidavit still responsible for you? thanks !

hi

I didn't go through this but you don't need a new affidavit of support. Until you become a USC, or work 40 quarters, the i864 that you already have in place is legally binding until you become a USC

so no new affidavit of support, in the instructions of the i864 indicate when a sponsor or joint sponsor is off the hook for the affidavit of support

If you are referring to the I-864 yes they are;

"Sponsors, joint sponsors, and household members (who have executed Form I-864, Affidavit of Support under Section 213A of the Act or Form I-864-A, Contract between Sponsor and Household Member) are bound by the contract terms until the applicant:

(1) Is naturalized;

(2) Has worked, or can be credited with, 40 qualifying quarters of work;

(3) Leaves the United States permanently; or

(4) Dies." (God forbid) :no:

hi

ditto

yes, and that's why the i864 is such a big deal for a lot of people, the years of commitment and responsibility, not even divorce dissolves the legal binding of an i864

the person singing the i864 is stuck with the responsibility until one of the 4 requirements above mentioned occur

and that's why a new i864 isn't necessary for removing conditions, the original i864 is still in place until you become a USC, or if you don't want to become a USC, work for 40 quarters
