Hi All,

I need your help with a few questions. I am engaged to LPR, our wedding is this year. He will be filing a I-130 for me and his step son. I want to be clear on the following:

1. What issues may cause the I-130 to not be approved, tax etc?

2. Is it best to use a lawyer or filing on our own is good enough

3. What documents do they require for the interview regarding our marriage

4. Will my frequent visits to the US pose a problem?

4. What is the wait period for Jamaicans

My fiancé is anxious to have us there but I want to ensure that everything goes smoothly and eliminate anything that will delay the process.

Yes. Sponsor's in com under 125% HHS of poverty guideline, never file income tax, no employment status....

2. Is it best to use a lawyer or filing on our own is good enough

You can do it yourself. Just do some research on here. You will be just fine and don't have to deal with headache from attorney.

3. What documents do they require for the interview regarding our marriage

A lot... Basically called boba fide of marriage .... Again, do the search. There are many forums that people talk about it.

4. Will my frequent visits to the US pose a problem?

Why would it be?

4. What is the wait period for Jamaicans

Are you planning to file AOS in the U.S? Or get a K1 visa from Jamaica? You can check on USCIS.org for processing time.

1. This is incorrect. You are mixing up approving the I-130 and approving the immigrant visa.

For the I-130, you husband needs to show that you are married and in a bona fide marriage. The poverty line, tax return, employment, etc. comes after the I-130 is approved and the beneficiary applies for an immigration visa.

1. Fraud, being a bigamist, etc.

2. This is a DIY site so people here won't recommend a lawyer usually.

3. There are guides that tell you, you have time to prepare.

4. Not at all.

5. There is a wait for all spouses of LPRs, and that wait goes up and down. Just a bit ago, there was no wait, the time to get the visa was just the processing time. But now, there is about a two-year wait. you should look at the "visa bulletin" which comes out each month from the government. That will tell you what cases they are working on now for the category you are in.

Unless there are complications (not mentioned here) he

can petition U & kid by filing I 130, once proven bonafide

it would get approved and sent to NVC for the process of add'l

fees to be paid & I864....once they have all things required

they will approved & send to embassy with interview date

also a checklist of what u should take to interview, like your

medical ,police records, photos & original bcert & marriagecert

I am also the spouse of LPR it took 3 years before we got a interview date. Are you in Jamaica? if you are not comfortable filling out the forms you can have a lawyer do it. We had a slightly complicated case and had our cost effective lawyer do our paper work. i wouldn't worry about the interview part just yet just focus on getting all the paperwork in order first (marriage certificates, birth papers for all 3 of you, taxes, travel docs, any and everything to show you two are in a bonafide marriage.) I appreciate it.... I am in Jamaica..... 3 years is a long time. My spouse wants me to quit my job next year and spend 3 months in Ja, 3 months in the US for the 1st half of the year and then do the same in the 2nd half. I'm not sure I want to based on immigration and don't want it to pose an issue with getting the immigration visa.

Wanted to reply to each person but I'm just not seeing the option.
